The latest in the Diebold saga in California is that Attorney General Bill Lockyer has decided to sue the company, saying they made false claims about their product. Amusingly, Diebold continues to mislead in their response to the lawsuit by noting that they are: "pleased Lockyer dropped the probe." When the only reason the probe has been dropped is because there's enough info to sue, it seems like there's not much to be "pleased" about.

California Says No More Diebold

California Says No More Diebold 04/22/2004 08:00 PM
Following story after story after story of questionable actions by Diebold with their electronic voting machines, culminating in the news that they knew they were breaking the law by using uncertified software in their machines during last month's primaries, a commission has recommended that California decertify all Diebold voting machines. Secretary of State Kevin Shelley has until the end of next week to make a decision on whether or not to follow the recommendation, and so far he's shown a good understanding of the issues involved (he is the one who said all e-voting machines should have a paper trail). Diebold's response is typical. Instead of admitting that they screwed up repeatedly in very damaging ways, they claim that being decertified "doesn't solve the problems" - suggesting that it's not their fault that they didn't solve their own problems and went ahead with illegally using software that hadn't been certified.

Diebold Settles With California 12/19/2004 03:47 PM
Now that the elections are over, and electronic voting isn't in the same sort of spotlight it was a few months ago, Diebold has settle d their lawsuit with the state of California, agreeing to pay $2.6 million for fraudulent claims made about their product. Some of that money will go towards better training of poll workers. The company also promises that next time (no, really) they will actually meet the standards that have been set and won't mess with the software at the last minute without telling anyone. It remains to be seen whether or not that actually happens, as the company seems to have a history of repeatedly ignoring the type of moves that might make people feel more comfortable knowing their vote was actually counted.

Diebold May Be Banned From California

Diebold May Be Banned From California 12/17/2003 01:13 PM
It's looking like some of Diebold's choices may be coming back to haunt them a bit. While they've been loudly unapologetic for security holes that were found in their offerings (and quick to pull the legal trigger on anyone who pointed them out), perhaps they should have spent a little more time "doing the right thing" rather than "covering up the wrong thing." The latest news is that California may ban Diebold from selling voting machines in the state, after investigating the claims that some of their machines were using software that had not been certified. Meanwhile, Fortune magazine has voted paperless electronic voting as the worst technology of 2003.

While Riverside County in California decided to sue California's Secretary of State, Kevin Shelley for decertifying electronic voting machines unless they put security measures in place, San Bernardino apparently decided that's too much trouble. Instead, they're just going to ignore the ban. They claim that the Secretary of State gave the approval for the voting machines once and now he can't go back on it. As far as they're concerned the ban never happened.

Diebold voting machines vulnerability 08/31/2004 08:20 AM
Cory Doctorow: Diebold's voting machines have a stunning security defect:
Manipulation technique found in the Diebold central tabulator -- 1,000 of these systems are in place, and they count up to two million votes at a time.

By entering a 2-digit code in a hidden location, a second set of votes is created. This set of votes can be changed, so that it no longer matches the correct votes. The voting system will then read the totals from the bogus vote set. It takes only seconds to change the votes, and to date not a single location in the U.S. has implemented security measures to fully mitigate the risks.

This program is not "stupidity" or sloppiness. It was designed and tested over a series of a dozen version adjustments.

The full story is over on Corante. On April 20th, the Oakland Tribune published a story regarding Diebold's alleged use of uncertified voting software in violation of California state law (Diebold knew of legal risks). The article cited and focused on internal legal memos from the Jones Day law firm showing that Diebold's own lawyers had warned of some of the possible illegalities. Online, the Oakland Tribune posted the documents in addition to the article. That afternoon, the Trib's parent company and the reporter were sued by Jones Day to have the documents returned. The judge ordered the documents returned, except for those already published on the internet (Judge: Tribune must turn over legal memos):Hmm, "already published on the Internet", eh? Click on that link and download them.  They are the Diebold electronic voting scandal's smoking gun, dead body, and confession note.   All nicely presented, annotated, and distributed, for your democratic pleasure.

It appears that the politicians in Riverside County, California are pissed off that the Secretary of State would stoop so low as to to want electronic voting machines to work properly and be secure before they can be used in elections. So, rather than, say, fix up those machines to make them so we can actually trust them, they've decided to sue Secretary of State Kevin Shelley. They don't seem to have come up with an actual reason to sue him, other than that they don't like that they have to put in place security features to make sure democracy works as it's supposed to. The most amusing part is the claim of Riverside County board chairman Roy Wilson, saying that they've run "29 accurate elections" with touch screen voting. That's exactly the problem. No one knows whether or not those elections were accurate, because there's no way to check to make sure the votes were counted properly or that no one tampered with the results. Of course, it seems likely that Mr. Wilson was elected via such touch screens, so it's no wonder he believes in them.

Diebold Knew They Broke The Law With
Uncertified Voting Machines

Diebold Knew They Broke The Law With
Uncertified Voting Machines
04/20/2004 04:44 PM
Every time I read another article about Diebold, you wonder what's really going on at the company. They clearly seem to be living in their own little reality where they simply ignore the very important questions people are starting to ask about their voting machines. I wonder how anyone in their right mind could use a Diebold voting machine after these fiascoes. Despite plenty of questions concerning their voting machines over the past few months, Diebold didn't do anything differently and knowingly broke their contract (and the law) with Alameda county by using uncertified software. Diebold's lawyers tried to get them around this by suggesting they claim that the software was "experimental" rather than "uncertified." Despite being clearly told not to do this, Diebold went ahead and used the uncertified and barely tested software which was rushed onto machines for the primary elections in California last month. Even worse, when an employee spoke up to point out that there was poor quality control and an aspect of the voting system was likely to fail, he was quickly fired. When you put together all of the information compiled over the last year concerning Diebold's voting machines, their inability to comprehend why people are upset, and what looks like their outright violation of the law, why would anyone agree to use such a machine during an election?
