After months of hearings and consideration , the United States Ninth Circuit Court of Appeals ruled that makers of peer-to-peer computer software (" P2P ") are not liabile for damages concerning copyright infrigement.

The decision hewed to the 1984 Sony v. Betamax ruling , which exempted videocassette recorder makers from copyright infringement, arguing that a tool isn't necessarily dangerous if some of its uses are actionable. Instead the court recommended that intellectual property owners pursue individual infringers. Additionally, defenders of the p2p software argued that the decision preserves privacy rights for users.

Peer-to-Peer (P2P) computing has received significant attention from the side of research labs and academia, largely due to the popularity of commercialized P2P file sharing applications such as Napster, Morpheus and KaZaa. In the P2P model, peers exchange data and/or services in completely decentralized distributed manner. Peers are autonomous, and are free to choose what other peers to interact with, and, in this point-to-point interaction, peers possess equal functional capabilities.

On the other hand, Knowledge Management (KM) is increasingly viewed as a core capacity in order to compete in the modern social and economic environment. Researchers and practitioners agree that those intellectual assets that are embedded in working practices, social relationships, and technological artefacts constitute the only source of value that can sustain long term differentiation, quality of services, innovation, and adaptability. Nonetheless, even due to a debatable success of current KM implementations, still unclear is how such matter should be managed in highly complex, distributed, and heterogeneous settings.

In the last couple of years, P2P and KM have followed different but converging paths. In fact, P2P technologies have left their initial “computational”, “anarchoyd”, and spontaneous fashion to embrace more service level domains and business settings. On the other hand, KM is questioning its centralized assumption based on the implicit belief that knowledge is managed successfully when it can be standardized and controlled. In this sense, it seems that while P2P is looking for value added domains to better exploit its technological potential, KM is looking for a technological paradigm more able to fit an emerging distributed organization of knowledge.

The convergence of P2P and KM creates new challenges for researchers to address: new methodologies to model, design, and deploy distributed KM solutions; theories and algorithms to represent the social and semantic dimensions of a knowledge network; mechanisms to cope with the dynamic autonomous nature of P2P and to provide means to support emergent network self-organization.

2nd Workshop on Semantics in Peer-to-Peer and Grid Computing at the Thirteenth International World Wide Web Conference 17-18 May 2004, New York, USA in cooperation with the GGF Semantic Grid Research Group (SEM-GRD)

The Semantic Web is widely accepted as a means to enhance the Web with machine processable content. However, mostly the Semantic Web is aiming at techniques and technologies for static information, in contrast to dynamic services or distributed computing. Several interest groups and efforts are working on infrastructure for enabling distributed computing. The organization of these efforts are in part top down organized efforts, involving multiple formal organizations and dedicated projects, and bottom-up efforts, sometimes started by single organizations or individuals in a grassroots effort.

The Grid is aiming at technologies which allow the flexible, secure, coordinated resource sharing among dynamic collections of individuals, institutions, and resources, enabling virtual organizations. Problems encountered include authentication, authorization, resource access, resource discovery, and interoperation of active services. The same problems are eminent in the Peer-to-Peer (P2P) area, where projects are typically organized in a bottom-up fashion. Reusable infrastructures like SUN's JXTA are emerging, attracting numerous applications. However, each application uses its own data format, and it is hard to see how applications interoperate.

A related area is Web Services: driven by industry efforts numerous specifications are developed, which are of interest for the Grid projects as well as for the Peer-to-Peer efforts. Although there is an agreement that Web Services would benefit from more semantics, little systematic research has been done on the problem of how to combine the notions of Web Services with the results of the Semantic Web, Peer-to-Peer and Grid computing.

The workshop will be organized in part around talks presenting research results in the intersection of the Semantic Web, P2P and Grid computing. Another important part of the workshop will be break-out groups, focusing on the amalgamation of Semantic Web and distributed computing. We hope the break-out groups will evolve into independent working groups and generate follow-up activities, which contribute to the technology areas. The proceedings will be published on the Web and a workshop report will summarize the outcome of the break out groups.

Several states are cracking down on peer-to-peer sites as hotbeds of illegal file-trading. Attorneys general from 47 U.S. states and territories have sent a letter out to P-to-P software vendors, saying they must re-engineer their software to prevent illegal file-trading do a better job of warning users of the dangers of trading illegal files. This action follows on news earlier this year that the states might get involved in the P-to-P fight.

The letter, signed by the attorneys general of California, Texas, Florida, and many others, calls for P-to-P vendors to also warn users about the amount of pornography traded through P-to-P software, including child pornography. "P2P users need to be made aware that they are exposing themselves, and their children, to widespread availability of pornographic material when they download and install P2P file-sharing programs on their computers," the letter says.

A new study suggests that Peer-to-peer music sharing has zero impact in record sales, and in some cases it may even be positive, says T he Guardian. Not completely unsurprisingly, the music industry is now really pissed off at even the mere suggestion.

To me it makes sense: I have bought several CDs just simply because a friend recommended something to me, and then sent me the MP3. Then I just rip the CD to Ogg Vorbis and dump it in iTunes... I actually never listen to the physical CD these days anymore; most of the CDs are used just once to get the data onto a hard drive. But I still keep the CDs as backups.

My digital music collection is my music collection. My CDs are my backups. I don't even have to burn them.

(And BTW: My CD player refuses to play about 10% of all the CDs I've tried on it lately. But my PC can rip 100% of them. So it's easier for me to actually rip the music than it's to play them on my ancient DVD player. So much for "copy" protection.)
