What's in a name? Well, if you're Microsoft that's exactly the question you want answered by a jury in reference to the term "windows." The question is central to Microsoft's argument that the name "Lindows" is too much like Windows, the Microsoft operating system. The only problem is that Microsoft wants the jury to decide if "windows" is a generic term today, not before the Windows operating system was released in November 1985. Unfortunately for Microsoft, District Court Judge Coughenour chose the latter in a ruling on February 10th.

Microsoft's trademark lawsuit against Lindows will continue to trial, possibly later this year, after a federal appeals court denied Microsoft's appeal request. Microsoft was questioning an earlier court decision that found Microsoft's trademark on "Windows" to be potentially invalid because the word is a common term. Microsoft had argued that the term wasn't generic in the computer industry, despite its general use to describe onscreen objects in various graphical systems dating back almost 30 years. And because Microsoft does own a trademark on the term, it had sued Lindows for naming its Linux distribution Lindows, a name that might confuse consumers.

Apple Computer has moved ahead of Toshiba to take the 5th position in U.S. PC sales during the first quarter, according to preliminary statistics released by Gartner Inc. today. Gartner said despite disappointing results for most vendors in the U.S. market in the first quarter, Apple's PC shipments in the U.S. increased 45.1 percent in the first quarter. The growth of the iMac and PowerBook categories were key drivers for the company during what has always been a traditionally weak consumer quarter. Worldwide PC shipments increased 10.3 percent in the first quarter of 2005, according to Gartner. Worldwide PC shipments totaled 50.4 million units in the first quarter of 2005, up from 45.7 million in the same period last year. Dell's worldwide growth rate fell below 20 percent for the first time in ten quarters, pulled down by a weaker performance in the U.S. market. Despite this, Dell's growth rate of 13.7 percent remained higher than the worldwide average, and it extended its lead in the worldwide rankings. Gartner said final statistics will be available soon to clients of Gartner's PC Quarterly Statistics Worldwide by Region program.
