surpris
ing lawsuit from Toysrus.com against Amazon.com. The two
companies had been happy partners for years -- and the relationship
between the two (where Amazon ran the website for Toys 'R' Us) was
often used as an example of a way that the two companies probably
saved each other. However, part of the deal included Toysrus.com
paying Amazon $200 million for "exclusivity." They claimed Amazon was
violating that exclusivity by allowing its independent merchants sell
toys and baby goods online as well. It's pretty obvious that this
would be nearly impossible for Amazon to stop, and would definitely be
bad for business. Still, Toysrus claims that after trying to "settle"
the manner peacefully, they were forced to sue. Now Amazon has hit
back. Instead of just responding to the lawsuit, though, they've
knocked it up a notch: claiming that
Toysrus.com has
failed to live up to their end of the contract as well and trying to
dissolve the contract between the two companies. Amazon claims
that Toysrus.com has done a bad job picking the top toy products, and
an even worse job keeping popular products in stock. These days,
Amazon probably is in a position to go it alone without too much
trouble. Toysrus.com, however, may be in a bit more trouble if they
want to recreate a quality e-commerce site without much notice.

Amazon
and Toys 'R' Us comes a judge's order today that
t
wo sides need to work together to solve this dispute. The
problem, of course, is that the complaints from Toys R Us are somewhat
unreasonable. They have an "exclusive" relationship to sell toy
products, but Amazon's offering allowing anyone to set up their own
shop makes it difficult to police to make sure that no one else dare
sell toys on Amazon's site (especially without pissing off sellers who
didn't realize they couldn't sell toys). In their effort to be as
annoying as possible, Toys R Us has apparently had someone watching
Amazon and documenting any time an item slips through. The judge
points out that its silly to order sanctions against Amazon for
letting a few items slip through, but that their "geniuses" better
figure out an automated way to stop it pretty damn quick. In the
meantime, Amazon is still hoping to completely
dissolv
e the relationship with Toysrus.com, realizing they could probably
do a better job on their own and not have to worry about all of this.
Toys R Us, meanwhile, seems to be thinking about
getting out of the toys business altogether.

mediation." There was some surprise a few years ago when Amazon
signed up Toysrus.com, who had made quite an effort to run their own
e-commerce site - but had tremendous difficulties in doing so. Still,
this legal dispute seems to focus on the fact that individual
merchants are also selling toys and baby products - and not that
Amazon has set up a specific shop selling competitive items. It would
be pretty difficult for Amazon to tell their various individual
merchants that they simply can't sell toys or games - which would
basically hand that entire market over to eBay.

Amazon's put up their sell-page for my next novel, "Someone Comes to
Town, Someone Leaves Town," offering a 32% discount off the
cover-price of $24.95 ($16.97 in total). The book's out in Februrary,
and coincidentally, I just a couple hours ago overnighted the final
version of the manuscript to my editor in NYC.
Someone Comes to Town is longest thing I've ever written -- longer
than Down and Out in the Magic
Kingdom and Eastern Standard
Tribe put together. It's a kind of "Little,
Big"-meets-"Crypotonomicon" story, a contemporary fantasy about free,
unlicensed wireless networking, set in Toronto's bohemian Kensington
Market.
I'm going to be posting the full text of this one under a Creative
Commons license again when the time comes, and I've got some beautiful
supplementary artwork to go with the gorgeous Dave McKean cover;
McKean provided five digital paintings to Irene Gallo, Tor's
brilliant, award-winning art director, and he's kindly granted me
permission to use them all on the book's website when I ship it.
In the meantime, there's an excerpt or

sales rank of two-million to a tri-digit 377. I don't know how you did
it, or how this new math works, but thanks. By the end of the week, I

full-text book searching service, books in the service
sold
9% better than those not in the search. While I do think the
service is great, and I'm sure it will boost sales, I'm not sure these
numbers mean anything. There was definitely a big boost in usage of
this service due to the
ton of publicity it received. So,
let's see how it's doing a few months down the road, and then it might
be worth talking about. In the meantime, various authors are
sti
ll complaining about the service. They quote an author of a
travel book who is worried that readers only want a couple of sections
and would print those out and never buy the book. I guess he hasn't
been ot the library lately. If people just need a couple pages out of
his book, they're not going to buy the book anyway.
