PATRIOT Act: The last refuge of
scoundrels
PATRIOT Act: The last refuge of
scoundrels
05/24/2004 11:34 PMOne of the more remarkable news stories to break in the past month, a
time of many remarkable stories, told of the strange saga of the
ACLU's challenge to the
PATRIOT act. It turned out that, under a provision of the PATRIOT
Act itself, the ACLU had been barred even from telling anyone about
its challenge to the PATRIOT Act, and had to fight the Bush
administration just to be able to announce its suit.
This bit of Kafkaesque logic may seem positively un-American. But
it makes sense within the increasingly divorced-from-reality,
driven-by-images, shoot-the-messenger world of the Bush
administration. Here, a secretary of defense get really steamed not
about the fact of torture in a U.S.-run prison (hey, shit happens!)
but about losing control of the flow of images about that torture.
Here, in the wake of the worst geopolitical strategic mistakes
committed by a U.S. leader since Lyndon Johnson's Vietnam escalation,
a president decides that his first priority must be -- a P.R.
offensive!
(Sorry for the digression: it's hard to stay on track when the news
provides so many sidings into bitter absurdity.)
Today the Electronic Frontier
Foundation filed an amicus curiae brief in the ACLU's case, and
Salon -- on behalf, in particular, of The WELL, which is a Salon subsidiary
-- is proud to be among the signers. They also include the Electronic Privacy Information Center,
the Center for Democracy and
Technology, the Center for
Constitutional Rights, the U.S.
Internet Industry Association, and the Online Policy Group.
What's at issue here, chiefly, is a provision of the PATRIOT Act
that (to quote from the EFF brief) "authorizes the FBI to compel the
production of subscriber and communications records in the possession
of a broad range of Internet-related communications service providers,
potentially covering billions of records from tens of thousands of
entities. These demands, known as National Security Letters (NSLs),
are issued without judicial oversight of any kind, yet allow the FBI
to obrain a vast amount of constitutionally protected information."
The brief -- a "friend of the court" filing in which parties who feel
they have interests at stake in a proceeding offer legal arguments
that complement those of the plaintiffs -- argues that the Act is not
only constitutionally overbroad but also "not cabined by any
intelligible standard": in other words, there's no way to make sense
of it in terms of the realities of the Internet today.
The WELL has a long history of helping define the shape of Internet
users' rights and responsibilities. As the Bush administration
continues to push beyond the edges of reasonable legal means in its
conduct of the "war on terror," we'll keep doing what we can to fight
back and protect the privacy of our users, customers and community
members.
(I will post a link to the brief as soon as it's online.)

Amazon Elephants
Amazon Elephants
03/06/2004 01:56 AMMy Amazon associate ID is used in a
variety of places other than by me. It’s the default ID for MTAmazon. It’s used in the JavaS
cript wishlist tool. This means that sometimes people buy things
that get credited to my Associates account. Sometimes there are
strange patterns that emerge.
According to my associate reports over the last six months, people
have bought nine books (including one for $75),
a calendar, and a DVD on elephants. And not
all at once either. These purchases were spread out across several
months. Someone likes elephants.
The Mating Dance of Elephants
The Mating Dance of Elephants
04/07/2005 07:50 AMAccording to a BusinessWeek article, phone companies trying to
get into the video market are running into an obstacle: movie studios
and other content owners. They aren't willing to license their
content for video-on-demand and other new distribution formats.
Frankly, I hope the studios continue to hold out against the
inevitable transformation of the video marketplace. The telcos are
pouring money into fiber and IPTV deployments because they are scared
about the competitive threat from cable companies, who are getting
into the voice market. At some point, all dressed up with nothing to
show, they may decide to take matters into their own hands. I'd love
to see the phone companies throw their resources and political muscle
into the process of blowing up the existing video value chain,
alongside the smaller innovators like Tivo and BrightCove.

Detroit Airport Gets Wi-Fi
12/19/2003 07:36 PMConcourse Communications built a Wi-Fi network in part of Detroit's
airport: The network will be free through the end of the holidays and
after that will cost $6.95 for daily use. Concourse went through some
restructuring a few months ago, and is finally getting caught up on
its contracted airports. It's had Detroit under contracts for years,
and the three New York/New Jersey airports (JFK, LaGuardia, and
Newark) are about to get fully built out as well instead of the
partial service now available....

swathes of Detroit are being reclaimed by nature. Roughly a third of
this 139-square-mile city consists of weed-choked lots and dilapidated
buildings . . . rather than fight this return to nature, urban farmers
have embraced it, gradually converting 15 acres of idle land into more
than 40 community gardens and microfarms — some consuming entire
blocks." [note: NY Times link]

Wi-Fi Draws Tenants in Detroit
01/19/2004 01:59 PMAn apartment complex in Detroit that draws executives from nearby auto
makers has Wi-Fi throughout: Residents who rent furnished
apartments--apparently many of them do--get the Internet access for
free. The owner of the complex calls Wi-Fi a "deal clincher" for many
potential residents. It seems as though the network administrator
authorizes users on the network by their MAC addresses. A service
provider is also targeting apartment buildings in Washington, D.C. For
new or old construction, Wi-Fi offers a much easier way for building
owners to offer Internet access than stringing cable throughout the
building....
