In the physical world we rely on eyewitnesses and increasingly,
especially in Britain, on cameras. In the virtual world, according to
Dan Geer, we're now approaching a critical fork in the road: "To the
left, we surveil people. To the right, we surveil data. I'm arguing
for data-level file-tracking because if I have to surveil either
people or data, I think it's highly important that we choose to
surveil the data, not the people. [Full story at

In this column I mention an audio interview with Dan Geer. It's full
of unique insights. Listen, for example, to this clip (2 min, mp3), on the value of
cross-disciplinary knowledge. Here's part of it:

I'm a week behind on extracurricular reading, so forgive the delay
in drawing attention to this often-hilarious essay on ghostwriting by
Joe Queenan in last week's NYTimes book review.
The whole thing is worth reading, but here are a couple of nuggets
for the IP-minded:
[I]n recent times a cloud has begun to hang over the
deliciously vaporous world of ghostwriting. This is because greater
transparency about the collaborative process has inadvertently led to
greater confusion. Things started to take a bad turn when the
basketball legend Charles Barkley complained that he had been
misquoted in his own autobiography. This gave rise to a niggling
suspicion in some quarters that ghostwriters were churning out books
with only minimal input from their nominal authors. Shocking! . .
.
And on Newt Gingrich's shameless (and stylistically criminal)
ghostwriting:
I do not think I am being overcritical by saying that such
prose lacks the epic grandeur of a Tolstoy or a Norman Mailer. But
what is particularly irksome for the reviewer is that he has no way of
knowing who is to blame for these hideous passages. Newt Gingrich is
still a powerful voice in the American political community and still
young enough to run again for high public office. If William R.
Forstchen is the one responsible for the lunkheaded plot and
comic-book dialogue of this infantile novel or the more recent
''Gettysburg'' (''He thought of Elizabeth, sweet Elizabeth, wondering
what she would say of him if he ever confessed his terror''), that is
one thing. But if Gingrich himself is the one firing off these
fusillades of malarkey, it could be a portent of some very unnerving
stump speeches in years to come.

The creator of open source operating system Linux , Linus Torvalds
,
asked Linux developers to acknowledge a
Developer's Certificate of Origin (DCO) . The DCO
specifies the authorship of each contribution to the Linux code, while
making clear the coverage of intellectual property under the General
Public License (
GPL ).
This increased
formalization of a major open source project is possibly in
response to the series of lawsuits filed by the SCO
Group , which turn on claimed ambiguities in the licensing and
authorship structures of Linux. Many observers do not
see the DCO as establishing total legal immunity.

NY Times:
Supreme Court Affirms Detainees' Right to Use Courts. The
Supreme Court ruled today that people being held by the United States
as enemy combatants can challenge their detention in American courts
— the court's most important statement in decades on the balance
between personal liberties and national security.
There's still a scary deference to the executive branch
in some of the language in these rulings. But there's also something
to cheer: the president can't decide what the law is.
The court punted on the Padilla case. He's an American citizen who was
grabbed on U.S. soil and slammed indefinitely into a military brig.
The court said his lawyer raised the case in the wrong court. Sheesh.
But there's overall good news. As one justice wrote, the "War on
Terror" does not give the president "a blank check" in defining the
rights -- or lack of rights -- the Constitution grants.
NY Times: Court
Hears Case on U.S. Detainees. The Bush administration yielded
no ground before the Supreme Court on Wednesday in arguing that the
open-ended military detention of United States citizens as enemy
combatants, without criminal charges or access to lawyers, was
justified both in law and as policy.
The
administration's claim here -- that the president and his aides alone
can decide to lock an American citizen away forever is a claim to
their right, and that of future presidents', to be tyrants.
It's incredible that this is even thinkable. But our collective fear
from the Sept. 11 attacks, and Congress' absolute spinelessness in
defending the Constitution it swore to uphold, has given Bush what he
so plainly wants: the opportunity to be the president who asserts, and
gets, absolute power.
Absolute power is always abused. Always. This kind of
absolute power -- making leaders the prosecutor, judge and jury -- is
the lynchpin of tyranny.
If the court upholds this abuse of liberty, it will be assisting in a
crime: If this assault on the Constitution succeeds -- if the
Constitution has truly become meaningless on something so fundamental
-- then we will have destroyed America to save it.
The stakes are that high.
NOTE: Slate's
coverage of the court arguments yesterday has a smart additional
feature. There are inserts linking to the audio of specific
exchanges.
