In February the Associated Press reported that hip-hop star Eminem had filed suit against Apple, claiming the company did not get permission to use Eminem's hit song "Lose Yourself" in a 2003 television ad spot for the iTunes Music Store. Now the news service reports that a federal judge has allowed the suit to proceed.

Darl McBride published the first of a promised series of open letters , which describe SCO's position on intellectual property. McBride argues that the general public license ( GPL )is essentially unconstitutional. This widely-read article then elicited a response from Stanford University law professor Lawrence Lessig , who replied that GPL is within the constitutional framework of intellectual property ownership.

In February, singer Eminem announced that he was suing Apple for having a commercial that showed a kid singing one of his songs. At the time, I wondered if compulsory licensing laws that handle the ability of a musician to "cover" a song would apply - but some claim that it doesn't apply to commercial offerings. Now, a judge has ruled that the case can proceed, and it could bring up some interesting legal arguments about fair use. Note that Apple didn't actually use Eminem's version of the song - just some kid singing it. That seems like a very fine line. Of course, what may complicate this story is the fact that Apple tried to buy the rights from Eminem, and still went ahead when he refused. It almost makes you wonder if the whole thing (including the lawsuit) is part of a publicity stunt.

In its latest lawsuit seeking to clamp down on leaks, Apple Computer has added credibility to several hot rumors, including plans to offer a cheaper Macintosh and its own line of office software.

Apple on Tuesday sued the publisher of Mac enthusiast site Think Secret and other unnamed individuals, alleging that recent postings on the site contain Apple trade secrets, according to court documents seen by CNET News.com. The suit, filed Tuesday in the Superior Court of Santa Clara County, Calif., aims to identify who is leaking the information and to get an injunction preventing further release of trade secrets. However, in filing the suit, Apple identifies specific articles that contain trade secrets, indicating that at least parts of those reports are on the mark.

Online journalists who published trade secrets about Apple back in December filed an appeal Tuesday arguing that the ruling violated the First Amendment and that Apple should first subpoena its employees or use computer forensics to determine the sources of the leak. Apple filed a civil complaint against unnamed individuals who allegedly stole trade secrets and posted detailed information about an unannounced Apple product last December, and on March 11, a California judge ruled that Apple has the right to subpoena the records of the three Macintosh sites that published details on an unreleased Apple product. "The California courts have a long history of supporting and protecting the freedom of the press," attorney Kurt Opsahl said representing the journalists. "The Court of Appeal will now get the opportunity to correct a ruling that endangers all journalists."
