Nicholas Carr sure is getting a lot of attention for his book rehashing last year's argument that "IT Doesn't Matter." Last week we had two different posts explaining why Mr. Carr's thesis was wrong. Now, Wired Magazine has let Carr speak for himself, and he does a dreadful job trying to defend his position. It is definitely true that many people misunderstood his thesis concerning the commoditization of IT. However, the industry execs he mentioned in the article did understand his thesis and responded with valid points. Carr's problem is that he thinks that those who are arguing against him don't believe that commoditization is happening. He's wrong. Everyone knows that technology is being commoditized. That's the process of technology advancement and competition. It's how the world works. So, by giving examples of how the companies that criticize him are commoditizing products he doesn't help his own argument. The point that he's wrong on isn't that products become commoditized, but it's when he believes the world ends with commoditization. Once a product is commoditized he seems to believe that all power to profit is gone. As we explaine d last week, that's not true at all. The power of commoditization is that it becomes a cheap input, rather than a final output. It becomes the building block of more innovation. What the smart company realizes (and Mr. Carr seems to miss) is that commoditization drives innovation, rather than kills it. By completely misunderstanding the arguments that show his thesis is wrong, Mr. Carr does himself a huge disservice. It would be great to see him actually debate the points raised against him. Instead, he just trots out a straw-man argument (that companies are commoditizing IT products). Everyone agrees with him that this is happening, so arguing about it is pointless. What he's confused about is that companies (and individuals) know how to use commoditized technology to create new opportunities.

June 21, 2004 | PARIS (AP) -- Jean-Marie Messier, the former chief executive of Vivendi Universal, was taken into police custody Monday in an investigation into financial wrongdoing during his time at the media and telecommunications giant, police said.

Police said Messier was being held by the financial crime brigade and could remain in custody for questioning for up to 48 hours.

Messier was ousted in July 2002 as the company's finances crumbled and its debt spiraled out of control.

French investigating magistrates are probing a massive share buyback in which Vivendi allegedly spent over $1.2 billion to prop up its own share price in the weeks following the terror attacks of Sept. 11, 2001.

Messier and his top team are suspected of buying back Vivendi shares well above the authorized volumes even while the company was presenting its financial results -- a practice strictly forbidden by stock market rules.

Prosecutors launched the investigation in October 2002 after a small shareholders' group filed a formal complaint. The group, APPAC, said the actions of Vivendi's former management deceived investors and caused many of them to lose money.

Earlier this month, as part of the same probe, Vivendi's former CFO, Guillaume Hannezo, was placed under investigation on suspicion of insider trading and share price manipulation.

Hannezo served as Vivendi's chief financial officer under Messier, who had dreamed of transforming the Paris-based company from a water utility into a media titan.

Messier's buying spree racked up billions of dollars in debt and took the company to the brink of bankruptcy, wiping more than 80 percent off its share value.

Vivendi has since been working to sell most of its entertainment assets, and recently spun off its film and television arm, including the Universal studios, to form NBC Universal, controlled by NBC's parent General Electric Co.

Investigators on both sides of the Atlantic have been examining financial information provided by Vivendi during Messier's tenure as chairman.

It looks like some internet scammers are finally getting some serious jailtime. A man who was caught running a phishing scam has just been sentenced to 46 months in prison. Meanwhile, the guy who conned lots of Wall Street insiders out of half a million dollars by telling them he was sellin g pre-IPO shares in Google has entered a guilty plea in the case, and now faces 51 to 63 months in jail. I have no problem putting such obvious scammers in jail for breaking the law. I do wonder, however, if the punishment really fits the crime.

I keep hearing about folks who have been kicked off or "jailed" from Orkut. I'd love to hear more about this. Who all is getting banned? Why? Are you given explanations? What happens when you try to fight?

Try to fight.  Why would I do that? If some system wants to fuck around with me - let them.  I remember everything.

When it comes time for asking for money - guess who gets laughed at?

Being jailed 3 times in one week - makes me feel proud.  There's only one thing better than gaming a system.  Getting caught and having everyone else find out about it.

We have an Orkut Community called Jail - BTW - for all you jailbirds out there.  No explanation yet - though it appears it's not just for friend establishing. Some are getting jailed for too many scrap submissions.

That's right: make sure the punishment really fits the crime. Over in Italy, if you are caught uploading or downloading an unauthorized file, you now face three years in jail. While older, more intelligent laws focused on whether or not the person copying files was doing so for commercial gain, this new law takes away that provision completely. It's a different law than the one that we just spoke about in California, but it's almost as bad. Update: And since we're on the subject of silly laws concerning music, Greece is warning people that they can be thrown in jail for buying an unauthorized CD - not just for making or selling it.

My pre-VCR generation has trouble being entertained by a movie more than once, but there are exceptions. Lord of the Rings is one: Giant trolls, gargantuan elephants, catapults firing heads, fierce bad guys with faces made out of cookie dough, fire-tipped battering rams, stirring music, flying dragons, all in one scene.
