lawyers who walk off with the real prize, where those involved in the
case get pennies for the dollars they lost. Now, the California
lawyers who convinced Microsoft to settle their anti-trust suit say
they deserve $258 million in fees -
approximately 25% of the entire settlement. When broken out into
pieces, it means $3,000 per hour for the lead attorney, $2,000 per
hour for 34 other lawyers and an impressive $1,000 per hour for
administrative work. Microsoft, of course, claims the fees seem a bit
high - but you could make the same argument about some of their
software. Meanwhile, Microsoft may get off without paying the $16 or
so they owe you for overcharging on Windows if you don't
fill out
the claim form. Yes, that $16 they overcharged you for Windows
represents just under one minute of administrative work done on this
case.

suing Microsoft for monopoly pricing in their sales to city and county
governments is interesting. It is not clear why any of these
plaintiffs need Windows. A lot of their desktops are probably
still running Win98. One can argue the relative merits of
GNU/Linux versus WinXP but it is obvious that GNU/Linux and the free
OpenOffice suite are more powerful than older versions of Microsoft
products. In a state with thousands of unemployed programmers
you'd think that these governments could have cooperated to hire 100
programmers to port some of their Windows-only applications to
Web-based or GNU/Linux apps. Instead they cooperated to hire 100
lawyers so that they can shackle themselves to Microsoft for another
10 years but at a slightly lower price.
[Back in 1997, I proposed
that the Federales hire Linux developers instead of using
Microsoft Word to write anti-Microsoft complaints. It has
been seven years and still our government prefers to hire lawyers
rather than programmers. Can we blame children if they decide to
go to law school rather than doing something that will add to the
G.D.P.?]

filing another set of lawsuits against more spammers. The
article estimates that they've now sued about 200 spammers - though,
they still don't know who many of them are. At this point, they're
just filing John Doe cases, and hoping to find out who they are at a

Windows that you overpaid for? Well, it looks like those lawyers
will have to settle for a bit less. Rather than the $286 million, a
judge has ruled that
they'll only get $112.5 million. Of
course, that means more of the settlement money is available to anyone
who bought Microsoft products in California and
fills out
the claim form. Amusingly, I just tested out the claim form and
found that, at least on this computer,
it didn't work in
Firefox, but worked just fine in IE.

weekend from the DEMOmobile conference, I'm glad this "glitch" didn't
happen until Tuesday. Apparently, there was a "radio breakdown" that
left almost all air traffic in SoCal without guidance. The culprit?
Microsoft. Apparently, the air traffic control system being used is
now run on Microsoft, after recently replacing a Unix-based system.
Just one problem:
the system needs to be rebooted every 30 days to avoid a
"data overload," and someone forgot to manually run the reboot.
Beyond the shock of discovering that this air traffic control system
can't handle very much data, you have to wonder why the reboot system
can't be automated, or at least have a "reminder" go off at some
point.
