After posting the item about spam and the recent relationship between Microsoft and whitelist provider IronPort, I got a letter from Reeves Little of Microsoft. Initially, he asked for some clarification about my opinions involving whitelists, but as we traded letters, we got into a pretty good discussion about Microsoft’s efforts to do something about spam and e-mailed viruses. I think that the whole thing is worth reading, since it reveals a side of Microsoft that outsiders seldom see. I’m going to edit out some personal items that have nothing to contribute and paste in the rest.

I've been having a great time exploring the maze that is Musarium, wandering about and peeking into into various nooks and crannies to find such exotica as the wonderfully bizarre birdhand book, and absorbing cultural artifacts and musings, including the poetic Visions and Icons (I really love the way the text works with the images on this), the atmospheric Familiar Ghosts (the texts will cue you on clicking through this somewhat dream-like landscape), the time-capsule imagery of Balkan Portraits (1906-1910), the breathtaking portraits of photographer Steve McCurry (famous for his National Geographic portait of the Afghani girl), the subterranean monologue of Grand Central: the View Down Under, and the shocking and heartbreaking Without Sanctuary: Lynching Photography in America. Dan writes "Ampex is another company resorting to an arsenal of patents to keep themselves alive. Now, their stock price price has taken off." This story is an interesting one. The company has been around for quite a long time, and obviously has done some very innovative things over the years. However, its patent windfall seems like a fluke. It certainly doesn't sound like any of the companies they've convinced to cough up these millions of dollars really made use of these patents -- they just came up with the same concepts independently. That, of course, demonstrates the weakness of the patent system. The point of the patent system is to publicize the info, so that others can build on top of it, while compensating the original creator. The problem, though, is that if innovations are done entirely separately of the patents in question, then you could easily make the claim that the original patents aren't valid. They should only have been granted if they were "non-obvious" and if others are coming up with the same thing independently, it's difficult to claim it wasn't obvious to the skilled practitioner. Either way, while the article suggests Ampex is trying to build a business model out of this, it's hard to see how it's sustainable for more than a few years. Sure, they're creating a licensing program, but the patents will run out in a few years -- and they realistically lucked into this patent windfall. They've just been hanging onto them for years, and suddenly noticed they were relevant. That's not a sustainable business model, but a lucky windfall.

A federal appeals court resurrected Louis' long-running federal lawsuit accusing the software company of patent infringement. In the decision by the U.S. Court of Appeals for the Federal Circuit, the court said a U.S. District Court judge in San Diego made a mistake when she ruled that patents held by TypeRight Keyboard Corp. for V-shaped keyboards with wrist rests were invalid. Louis co-founded TypeRight in the early '90s.
