Canadian music industry's fake stats

04/10/2005 07:25 AMCory Doctorow:
Copyfighting Canadian lawyer Michael Geist has a hell of an article up
on First Monday where he dissect the funny arithmetic the music
industry has used to justify its calls for restrictive new Canadian
copyright laws to "save Canadian aritsts." This kind of incisive
analysis cuts straight through the music-industry BS -- it's a breath
of fresh air that is sorely needed.
Although royalty rates vary between artists, the consensus estimate is
that the combined royalties earned by both the performer and the
songwriter stand at approximately 12 percent. In fact, Sanderson
Taylor, a leading Canadian music law firm, maintains that the actual
royalty earned by the artists is typically even lower, since the
producer’s royalty is taken from the artists’ compensation and
many contracts do not provide for a full royalty for CD sales [21].
Assuming artists receive the full 12 percent royalty, the annual
royalty loss attributable to music downloading in Canada is about
C$655,000 (12 percent of C$5.5 million). For those that claim that the
full industry loss should be counted, the annual lost royalty for
Canadian artists stands at C$2 million...
Given the tens of millions of dollars that the Canadian government
spends annually to support the creation of Canadian music [23], it is
apparent that the relative impact of lost royalties due to
file–sharing pales by comparison.

09/01/2004 06:24 AMWasn't Jack Valenti just telling us that
DVDs
last forever? Maybe not. As many people are now learning,
digital media has a pretty rapid decay rate. The latest to discover
this was a reporter who, five years ago or so, had fallen for that old
(har har) "paperless office" gag that has been pulled before. He
bought a CD-RW and scanned in all sorts of stuff (including photos and
old articles he'd written) -- and then made the fatal mistake: he
tossed out the original copies. Glad to have the filing space back,
he proceeded to shove the CDs on a shelf somewhere and forget about
them for years... until now. Partly out of curiosity, he pulled out
these backup CDs, put them in his CD drive and
discovered the wonders of Windows error messages. He
begins to wonder (uh oh) what will this mean for all the CDs and DVDs
he's been paying good money for over the years. It would be nice if
he could back them all up, perhaps multiple times to various different
storage media, but the entertainment industry isn't real keen on that
idea, seeing as they're actively
stompin
g out those who try to help you save your own digital files.

The first post describes the crazily harrowing landing you have to

After a normal flight, we went into a tight, corkscrew

03/30/2005 08:42 PMSimon Willison: x Jon, you need Greasemonkey ... I’m using this
for my final year project, a decentralised web annotation system that
lets you annotate pages, storing your annotations locally and then
sharing your public annotations as a feed (similar to the way RSS
aggregators work). The trick there is to run a local web server on
some
port, then have the Greasemonkey user script (eventually a full
extension) communicate with that local server to store and retrieve
data. I’m using Ruby on Rails' built in WEBrick server to
prototype the service, and it’s working a treat. I want. I want.

"We will now back down!"
"We will now back down!"
04/16/2004 12:56 PMThere's a slightly Freudian typo in BBC News' latest
article about the joint Blair / Bush press conference in the
states. Or at least I assume it's a typo and Blair didn't just squeeze
in a bit of a massive policy U-Turn while no one was looking:
Outlining the coalition's strategy, the prime minister
said: "First, we stand firm. We will do what it takes to win this
struggle. We will not yield, we will now back down."
It probably won't be there for long, so enjoy it while you

DING DONG - the WITCH IS DEAD!
The 17 year
nightmare is over.
The rape and pillage is finally complete.
Now what?
Will the new Adobe grok the new paradigm of tools?
Will Rob Burgess ever be able to set foot in Silicon Valley again?
Isn't his reign ending on a down note? Kind of pathetic - no? Lost
opportunity, drop the ball - all that?
And what of Norm Meyrowitz or David Mendels? Who cares?
I bet Kevin Lynch has a job - he's pretty smart - but the rest of
them - lord knows they an teach a class in how NOT to run a software
company.
Maybe Mr. Chizen (who once called Acrobat the 'roach motel of
standards') - will get a clue.
Either way - I'd sure like the name back.
And I'd take the Director product line off their hands - if they'd
like me to. They more or less have abandoned it. In fact they should
pay US to do that.
The name Macromedia started as the name of our new
'compound document' architecture we were working on. But they
cancelled the project, got rid of most of our programmers and kept the
name. Here's the Macromedia
story - from their POV.
Anyone remember the dualing patent lawsuits fight? Well I got to
testify AGAINST Macromedia - helping out Adobe. I wonder if John
Warnock remembers that.
What are the odds that something will now happen - bare to midlin?
But I'd be honored to return - to help out my former company.
The previous caretakers were slimeballs - but Adobe has always had
a cooler panache. Either way - they had better get ready for some
change - cause who designs software to be sold in a box nowadays?
Who designs software that's single user or that doesn't have a
built-in community?
Who designs software that's based upon 'patent' protection or which
doesn't have an on-line component to it?
Like I said - I'd be honored to help Adobe out - but they'd have to
go open source. I've grown at least over the years. But have
they?
