Apple said Wednesday that its iTunes Music Store set a new download record of 3.3 million songs in the week since the third-generation store was introduced. 500,000 of those downloads came in the form of free songs from popular commercial artists made available as part of a "Free Song of the Day" promotion to celebrate the store's one-year anniversary. Last week Apple said the iTunes Music Store currently sells 2.7 million songs per week. Subtracting the free songs, this suggests that the store's weekly business may have been slightly more brisk than usual.

The auction was removed from eBay's site and an Apple executive said it was within someone's rights but so technically complicated it was basically impossible anyway. Regardless, George Hotelling, who brought the First Sale Doctrine into the online music debate, has sold a song he purchased through Apple's iTunes Music Store. The only way to legally transfer ownership of the song also required transferring ownership of the entire account.

Apple is on track towards selling 474 million songs on the iTunes Music Store during 2005 as the company is currently selling 5.5 million downloads a week, according to Piper Jaffray analyst Gene Munster. "Based on yesterday's update, it appears that the weekly iTunes run rate is approximately 5.5m songs per week, up from the 3.5 to 4.0 million range in the September quarter." Gene Munster said. "We now expect iTunes downloads in the December quarter to reach 68.5 million vs. our estimate of 52." Last week, Apple announced that it had surpassed 200 million downloads with the 200 millionth song downloaded by Ryan Alekman of Belchertown, MA.

Jon Johansen, also known as DVD Jon, has once again attacked Apple's method of protecting iTunes bought from the Music Store. The Norwegian programmer famous for breaking the encryption software that protected and localized DVDs, has found a way of buying digital rights management-free tracks using his PyMusique application. Since the iTunes Music Store adds the digital rights management tag after a track has been bought and downloaded, Johansen has devised a front-end that, according to engadget, "conveniently neglects to wrap the file with any copy protection."

Apple on Monday confirmed they have closed what's described as "a security hole" in the iTunes Music Store that allowed users to purchase songs without DRM attached. As a result of closing the hole, users of iTunes older than version 4.7 will need to upgrade in order to continue purchasing songs. This update also locks out users of PyMusique, a software application for Windows and Linux that served as an alternate interface to the iTunes Music Store.

DVD Jon has created a program which bypasses the DRM stage of the downloading process when purchasing songs from iTunes. One still pays for the tracks, and FairPlay is not included.

PyMusique [is] a Python-based utility that offers a "fair interface to the iTunes Music Store", co-written with Travis Watkins and Cody Brocious. The app provides the usual ITMS features - access to song previews and the ability to set up a payment account and to use it to buy songs - but there are two crucial differences.

First, PyMusique allows you to re-download songs you've purchased. So if your hard drive goes up the Suwannee and you haven't backed it up for a while, you can re-acquire your ITMS-sourced song library. Second, none of the tracks you download will be encumbered with DRM.

Of course, it's of very questionable legality. Quite apart from potentially bypassing Apple's FairPlay copy protection system - a no-no according to Europe's European Union Copyright Directive (EUCD) - running the software infringes the terms and conditions ITMS user agree to abide by when they set up an account.

Apple's iTunes Music Store is giving away iPods and a prize package comprising a 17-inch PowerBook, iPod and 10,000 song gift certificate as the service counts down to 100 million songs sold. There's a way you can participate even if you don't want to buy new music, however, according to gadget site Engadget -- and it's actually spelled out in the giveaway's rules. God damn it, Apple. So I don't buy a lot of albums from iTunes Music Store, because I'm cheap and Denton had to get another set of gold fronts, but I've got a couple here and there, which I have unlocked with Playfair/Hymn. Now part of the whole shtick with Hymn is that even though it strips the iTunes DRM, it leaves your email address and other unique purchasing information in the protected AAC file, ostensibly to symbolically signify that Hymn users aren't trying to spread their fairly-purchased music files to the whole world, but instead to whatever devices they want. I unlocked mine so that I could be sure to play them after I had reformatted my machine. I'm pretty sure Apple has a method of reauthorizing your computer, but that's a hassle. But now the new version of iTunes has recognized that the DRM-stripped M4P files were purchased from iTMS and is telling me my (reformatted, reinstalled) machine isn't authorized to play them. So gee, thanks for that, Apple.

Wednesday, April 28th marks the one-year anniversary of Apple's iTunes Music Store. The company has announced that since the iTunes Music Store opened, it's sold more than 70 million songs -- well short of the 100 million song target that Apple CEO Steve Jobs mentioned last October, but still exceeding Apple's "wildest expectations," according to Jobs.
