Today's craven opinion in US vs. Moussaoui is worth a read, if only as an example of some of the most results based backwards reasoning since Bush vs. Gore. Just 2 months ago, no less a figure than right wing zealot Scalia said (in Crawford v. Washington) that the 6th amendment mandates that in all criminal prosecutions the defendant shall enjoy the right to be confronted with the witnesses against him, a practice he noted dates back to Roman times. The 4th Circuit doesn't seem to have read that decision, or the 6th Amendment to the Constitution. In their haste to assist the government's prosecution of Moussaoui, they are throwing out the Constitution, the documents that public officials in this country take a oath to defend. Shame on Chief Judge William W. Wilkins, who joins Roger B. Taney of Dred Scott ignominy in the list of American jurists who in the passion of the moment have forgotten their duty to America's highest ideals, and its fundamental law, the United States Constitution....

Six years after the famous "Melissa" mass mailing viruses, some started to say that mass mailing viruses were on the decline. Of course, for the publicity departments of anti-virus firms, that's bad news. They need some sort of virus scare every other day or so to prop up sales. So, wouldn't you know it, just as we're told that mass mailing viruses are on the decline, Symantec comes out with a screaming warning about some new mass mailing virus. Of course, when you look at the details, even they admit that it's a "low" or "moderate" threat. However, that's never stopped the company from ringing the fear bell to try to drum up some extra sales.

On Copyfight, Jason Schulz calls out to a recent Second Circuit opinion in which the value of fair use is affirmed, even when the material itself is taken from an infringer. This is the right decision: if I want to make a critical documentary about a Star Wars movie, and the only way for me to get my clips is by downloading them from Kazaa, my reuse of the material should be fair use -- even if the person who ripped the movie and put it on a P2P net is infringing.
"Fair use is not a doctrine that exists by sufferance, or that is earned by good works and clean morals; it is a right--codified in § 107 and recognized since shortly after the Statute of Anne--that is "necessary to fulfill copyright's very purpose, '[t]o promote the Progress of science and the useful arts . . . .'"

One of the highest profile spammers around has been Scott Richter and his company "OptInRealBig." Richter has received plenty of coverage over the years for such stunts as suing SpamCop for "damaging his reputation". He was also one of the major characters in Brian McWilliam's fascinating < i>Spam Kings book -- which gives you the impression that Richter really likes the idea of becoming a legitimate, non-spamming email marketer, but can't seem to stick to it. Richter also got off extre mely lightly last year in the case which NY State filed against him with great fanfare. While he got away with just a slap on the wrist in that case, both Richter and OptInRealBig are now declaring bankruptcy. Of course, don't get too excited just yet. The company claims that it's doing just fine and is actually growing. The point of declaring bankruptcy is just to consolidate all the other lawsuits that have been filed against the company (including a $40 million suit from Microsoft) -- and to reorganize the business to keep on churning out those emails.

New Toys: Nokia 6600. I'm starting this year with a brand new phone. For the last 8 months I used a Sony Ericsson T68i, but I've been disappointed by this phone. It's true that considering the feature-set it was cheap, but the fact that I had to reset it every few calls because for some reason it randomly stopped working made it a pretty poor phone.

So I went back to Nokia, buying a 6600. This has been a totally weblog-driven purchase: I picked the 6600 after reading Joi Ito's and especially Russel Beattie's weblogs.

It took a while to get it working properly with my Mac (it's not supported by iSync), but after some googling I got it to synchronize with my Address Book (pictures associated with people in the address book are sent to the phone, cool) and I can get on-line via bluetooth/GPRS with my PowerBook on the road.

The built-in camera seems to be almost usable: I can take a picture and send it via email right away, which is kind of cool. The included Opera browser works pretty well and the screen is big enough to let you do some web surfing directly on the phone.

Another cool feature is the ability to use any midi file as a ring-tone and ring-tones can be associated with specific users or groups. I guess I'll let people in my address book choose which song they want to be associated with when they call ;-)
