Frank Quattrone Guilty, But of What?

Frank Quattrone Guilty, But of What? 05/03/2004 03:22 PM

  • AP: Quat trone guilty on all counts. A federal jury in Manhattan, deliberating on its second day, returned guilty verdicts on all three counts against Quattrone -- obstructing a grand jury, obstructing federal regulators and witness tampering.
  • This may well be overturned, because by almost all accounts the judge was biased for the prosecution -- and blatantly so. Quattrone's defenders, who remain legion, insist he was just a fall guy for the bubble era. Back then, they say, "Everyone did it." Maybe so, but those were hugely corrupt times, and Quattrone was the poster child for the rampant sleaze that turned Silicon Valley into an ethical cesspool. More later...

Frank Quattrone, the famed investment banker who was a star in taking Silicon Valley companies public during the boom years, has now been found guilty of obstruction of justice for his emails to colleagues suggesting they destroy certain files concerning stock allocation. While the documents may have been destroyed, that email wasn't... once again showing how emails can come back to haunt people. Has anyone done a study recently looking at just how many fraud cases these days involve email evidence?

Back in December, we noted that the AOL employee who leaked the entire company's customer database to spammers tried to plead guilty, but the judge rejected the plea, saying he wasn't even sure if a crime had been committed. It appears the judge spent January catching up on the latest law books, and now agrees that, yes, a law has been broken, and, yes, the guy can plead guilty. He now faces a few years in jail and the prospect of paying a few hundred thousand dollars to AOL for the cost of cleaning up the mess he caused.

    Not 'Innocent'

You don't have to be a fan of Frank Quattrone to doubt, now that he's been found guilty of three felonies, whether justice has been done. When a trial judge appears as biased as the one in this case apparently did, how can a trial be fair? But if the Quattrone case -- however it turns out in the end -- does anything to help drain Silicon Valley's ethical swamp, it will have served a valuable purpose.
