Apple's New DRM Reneges on Your Purchase Conditions, Picks Your Pocket

"The new iTunes has stricter DRM than the last version, limiting the number of times you can burn your playlists to seven (it used to be ten), and detecting and blocking similar playlists. Jason Schultz has some good ranty analysis about what this means:

So after one year and 70 million songs, $0.99 now buys you less rather than more -- seven hard burns instead of ten soft ones. What will Apple 'allow' us to do with the music we 'buy' next year? three burns? one? zero?

And what about the songs you've already bought? Don't we get to keep the rights we had before the change?

Well, Apple has conveniently reserved its rights to make changes -- unilaterially -- to its DRM and your ability to make fair use via its Terms of Service and Terms of Sale pretty much anytime it pleases, without even having to give you notice. Link" [Boing Boing]

I can't find it right now, but I saw a post somewhere noting that you could actually keep the songs you've already paid for at the old licensing by not upgrading to the new version of iTunes. The problem with this, of course, is that you can't buy any new ones. Right.

When DRM Goes Wrong or Why I'm Not Using Microsoft Reader Any More

"I was going to do some reading this evening on my computer. I had a copy of the Devil's Banker in Microsoft Reader format. When I tried to open it though, i got a message that informed me that that the security software had been updated and that I needed to update. No problem, I go to the update page but it tells me, I'm updated and activated just fine. Except, I'm not. The e-book won't open. I try to activate the reader again and the fun gets more interesting. I get a note saying that my acc't only has six activations and all of them are used. Let's see, by my count, I have two laptops and one PocketPC active. That would mean three activations left (and of course, the COMPUTER IS ALREADY ACTIVATED)... Yikes. Pulling up my PocketPC, I get the same infuriating message but it does activate again and the book opens there (but still not on my computer).

Bottom line. MS Reader is DRM at its worst. Unlike competitive solutions, like iTunes, Reader won't let me authorize AND de-authorize a computer. Yes, you can request more authorizations from MSFT, but that's sort of useless when you're trying to read a book. I'm staying away from Reader at this point and going to use Palm Digital Media that has a far friendlier DRM that's never locked me out of my content yet. Like most users, I have no objection to DRM, it's necessary to prevent abuses but should never, ever be something a legitimate user should bump into, like i kept bumping into tonight...." [Michael Gartenberg, via Scobleiz er]

Except that, I bought a book from Palm once. Once. They tied my credit card number to the title, and three years later, I have no idea what that credit card number was, so I can't access the book anymore.

So in summary, iTunes, MS Reader, and Palm Digital Media DRM: bad.

This is what really scares me about libraries getting into the digital files business, even outside of all the issues surrounded subscription-based access versus ownership. When terms change on a whim, upgrades take away existing rights, and files become locked and inaccessible, how is this going to affect how we circulate titles to our patrons? It's not like libraries have any leverage in this situation since publishers and Congress are doing their best to eradicate fair use rights, including the right of first sale.

Investing in Linked In and some explosive growth numbers.

Last week I had another great dinner in San Francisco with Reid Hoffman, founder of Linked In. Reid is one of the most impressive and visionary friends I know.

I am very proud to join its investors list. Reid has secured Series A financing of $4.7 million in November last year. The investment was led by Sequoia Capital, the venture investors behind well-known Internet brands such as Yahoo!, Google and PayPal. A round with business angels that I participated in will be announced within a few weeks.

Here is some information about Linked In's recent growth, if you are interested:

600,000+ users (30,000+ growth per week)
28,000,000+ email addresses sent through Linked In (3,000,000+ growth per week)
12 months old

Within the 600,000+ users:
265,000+ international users
120,000+ senior management-level users
8,000+ entrepreneurs
10,000+ VCs
100% professional users

and 28,000+ in France only.

Congrats, Reid ! [Loic Le Meur Blog]

Oh goodey. 600,000 more locked in people.  Isn't the world a wonderful place to make money?

I wonder if Reid, Joi and Loic will be investing in military industrial complex companies next?

Sure LinkedIn is just a wonderful vehicle for meeting people - but at what price?  And who owns that data?  Who owns those people?  I wonder why Reid doesn't support FOAF or being open - at all?  What does that say?

And why would Loic invest in such a company?  To make money - that's why.  At our expense.

Oh - did I forget to say - Reid is just such a nice guy!

Danny Ayers has a solution for the OPML "give me permission" clause in the latest Dave Winer effort.  What I love about Danny (and folks like Ben Hammersley - too) is that they always seem to come up with solutions that stay backwards compatible (with the 'simple way') while then also providing an elegant rdf way of doing things.

Thanks Danny!

And BTW - for the record - I AM a fan of OPML - but that doens't mean that open standards get to be closed - just 'cause the author changes his mind.  Once open, teh cat's out of the bag!

Sharing, the web way

I'm not a fan of OPML, I think it's a truly awful (and unnecessary) format - other people have found < FONT color=#333366>it problematic too - but I did think Dave Winer's Share Your OPML! site looked interesting, especially when there was a little SDK available. But then yesterday I read Eric's post pointing to the floater Dave had left in the pool :
If you wish to use the data for a different kind of application, or convert the data into a format other than OPML, for redistribution, it's likely we'll say yes, but you must ask first.

Anyone that's had dealings with Dave in the past will know what this means. Leigh asked (in comments) but had his request deleted. Basically Dave wants control, and he believes the formats will give him that control (remember the RSS patent application?).

I'm all for republishing, but not with strings attached. I don't want material under my copyright abused in this way. So I politely asked Dave to remove references to sites I maintain from his data. Anyhow, Dave's response was:
Do you want to make a legal case out of this?

Personally I thought that was pretty sad, but that might in part be cultural bias - being English I tend to think of etiquette before litigation. Whatever, unfortunately for Dave, and fortunately for the rest of us, formats aren't such a lever any more because the web will either ignore or work around attempts at lock-in.

I think the most sensible thing is to simply ignore Dave's site, but for purposes of demonstration, here's a workaround. The key obstacle is that Dave insists that you can't republish his data unless it's in OPML format. If it is OPML, you don't even have to ask. Ok, here is another version of the index file that points to all the others at "Share Your OPML!". This is still OPML format. Please do with it what you like. Incidentally, this new file is also valid RDF/XML.

Given that OPML is as thinly specified as it gets, and RDF/XML is designed to make it easy to make XML formats RDF compatible, it wasn't particularly difficult. Here's what RDF-compatible OPML looks like:

<opml opml:version="2.0"
xmlns="http://opml.scripting.com"
xmlns:opml="http://opml.scripting.com"
xmlns:rdf="http://www.w3.org/1999/02/22-rdf-syntax-ns#">
< ;head/>
<body rdf:parseType="Resource">
<outline opml:text="John Blog" opml:ctUpdates="8" opml:type="link" opml:url="http://example.org" opml:whenLastUpdate="Wed, 14 Jan 2004 03:28:00 GMT" />
</body>
</opml>

I first had to add some attributes to the <opml> element to give the XML namespace support. That top element becomes a resource in the (stripey) RDF interpretation, with head and body as properties, their contents being other resources. To keep things simple I just ignored the contents of the <head> element, so that gets interpreted as a triple with an empty object (I must check on the semantics of that). The element itself is mandatory in OPML, so that has to stay.
The <body> in effect contains a set of resources of type outline, which is easy to express by adding the rdf:parseType="Resource" attribute on the parent. The attributes of the <outline> elements all slip neatly into being RDF properties with literal values.

Couple of points that probably need explanation - since the spec update there's been no need to include a root <rdf:RDF> element. If the consumer knows it's RDF, that's good enough (the W3C's validator has check box: "RDF is NOT enclosed in <RDF>...</RDF> tags"). Also the use of unqualified attributes has been deprecated, so it should be opml:text="..." rather than just text="...". This makes the code look a bit uglier, but if you're using a lot of namespaces it does make mistakes much less likely.

I made the changes using search and replace, but this could easily be automated using XSLT. But if you are planning on using Userland format data from anywhere else, it's probably a better bet to use something a little less generic than the approach above (stylesheets for OPML to OCS and Userland RSS to RSS 1.0 are linked in the comments here).[Raw]

Suing carriers over locked handsets

Suing carriers over locked handsets 06/09/2004 02:51 AM
A consumer-rights group is bringing suit against US mobile carriers for locking their handsets:
In the lawsuit, the foundation said that because the companies all use the same wireless network standard, called GSM, customers should be able to use the same phone across those carriers' networks just by changing out an easily-replaced unit called a "SIM card" inside the phone.
The carriers may claim that locked handset let them offer cheaper service -- because they keep you from using your subsidized handset with another carrier, but I don't buy it. I got a free T-Mobile handset by promising on pain of an enormous cancellation fee to stick with them for a year. In the meantime, why shouldn't I be able to rent a SIM when I go to Toronto and put it in my phone? Why shouldn't I be able to loan my handset to a friend from out of town so that she can put her SIM in it and log on to her service? Link (via Hack the Planet)

Locked phones making number portability
a pain
12/04/2003 11:59 AM
Surprise, surprise, some people are finding out the hard way that when you switch carriers, you can take your number with you now, but usually not your phone. Besides the incompatibilites in networks (Verizon and Sprint use CDMA, Nextel, T-Mobile, AT&T Wireless, and Cingular use GSM) most carriers lock their phones so that they can't be used with anyone else. It is possible to unlock most phones so they can be used on another carrier, thought it's not always easy, so if being able to take your phone with you is important, you probably should just suck it up and pay extra for a phone that comes unlocked in the first place.
