Chuck D of Public Enemy has always been a strong supporter of freeing up music. Years ago, when Napster first appeared on the scene, he was one of the first to publicly stand up in support of Napster, and even went on TV to debate Lars Ulrich from Metallica on the subject. Here's a fascinating i nterview with Chuck D & Hank Shocklee of Public Enemy, talking about how copyright law forced them to change the style of music they created entirely. They claim that two of their earlier albums would be impossible to create today, but were possible early on when record execs hadn't trained their legal guns on music sampling yet. Now, those same songs, that used many different samples would be impossibly expensive. Chuck D claims that the group had to "change our whole style" between albums in order to take into account new copyright rules. Also, when asked about others taking their music and remixing it themselves, he says: "I think my feelings are obvious. I think it's great."

The Joint Committee of the Higher Education and Entertainment Communities issued a report on filesharing and copyright infringement on college campuses. The group found that awareness of copyright problems had grown, and many solutions mounted.

The Recording Industry Association of America ( RIAA ) filed more than five hundred lawsuits against filesharers for alleged copyright infringement.

Because a recent federal appeals court decision prevents subpoenas citing the Digital Millennium Copyright Act from being issued prior to the filing of lawsuits, defendants were identified only by their IP addresses pending subpoenas being issued to their ISPs.

This appears to be a successor to last year's subpoena campaign , which probably helped reduce aggregate file-trading in 2003 .

In February, singer Eminem announced that he was suing Apple for having a commercial that showed a kid singing one of his songs. At the time, I wondered if compulsory licensing laws that handle the ability of a musician to "cover" a song would apply - but some claim that it doesn't apply to commercial offerings. Now, a judge has ruled that the case can proceed, and it could bring up some interesting legal arguments about fair use. Note that Apple didn't actually use Eminem's version of the song - just some kid singing it. That seems like a very fine line. Of course, what may complicate this story is the fact that Apple tried to buy the rights from Eminem, and still went ahead when he refused. It almost makes you wonder if the whole thing (including the lawsuit) is part of a publicity stunt.

The Copyright Board of Canada issued a ruling on " private copying ", largely via peer-to-peer computing, with several components. First, downloading is acceptable, but uploading is not (presumably to target hyperpirates). Second, new mechanisms for levies were described, freezing current ones, allowing new charges.

the Copyright Board said uploading or distributing copyrighted works online appeared to be prohibited under current Canadian law. However, the country's copyright law does allow making a copy for personal use and does not address the source of that copy or whether the original has to be an authorized or noninfringing version, the board said.
