Apple 's iTunes
enterprise
sold its

for a fee per song.
In another milestone the
Creative Commons marked one year of operations. The project seeks
to promulgate

lau
nch their own music download store, Apple has a carefully timed
announcement
adding an affiliate program to
iTunes, so that individuals and organizations can get a tiny piece
of the pie for every paid download they push on people. The end
result, of course, will be to make iTunes' already miniscule margins
even smaller. This, obviously, is
of
little concern to Apple, since they still view the iTunes store
(properly) as a promotion for selling iPods. Meanwhile, Napster,
fresh from
sheddin
g their core Roxio software business appears to be in complete
denial about the marketplace. In an interview, Napster's CEO
brushes off all of the competitive questions
by pretending the real competition isn't competition, and then
pointing out how badly they trash the non-competition. Obviously,
Apple's iTunes is their main competition. However, he brushes this
aside, pointing out that Apple only does pay-per-download, whereas
Napster does pay-per-download
and subscriptions. Since iTunes
has no subscription offer, apparently, they're nothing. No customer
anywhere would
ever think of replacing one with the other,
apparently. Of course, he seems to be forgetting two things:
customers define what the competition is by deciding what products are
substitutes, and it's pretty clear they consider iTunes and Napster
substitutes. He also seems to completely ignore file sharing systems,
which while much of the sharing may be in violation of copyrights, is
still competition. So, with those in his blind spot, the competition
he does bring up is Wal-Mart and Sony, two companies who everyone knew
did a dreadful job creating music download stores. Any time you have
your CEO defining away your biggest competition on a technicality and
then bragging about how you beat the competition who had already beat
themselves, you should be worried.

global music industry is celebrating that there are now
over 100
legal music services available. Don't ask what kind of sites make
it to the list, that's not the important part. The important part is
that now music lovers have more music formats to choose from than
ever. Woo hoo! So instead of making it easier for people to download
music in a simple, transferable format, we now have a bunch of
different formats that we have to track down from over 100 sources.
Sounds like progress to me.

their legally purchased iTunes song on eBay? Based on the right
of first sale, it should be perfectly legal, but there were plenty of
thorny questions brought up. In fact, they were so thorny that
eBay
killed the auction. Now, via
Engadget,
we learn that eBay may be reconsidering. They're testing a program
where
people will
be able to sell their digital downloads under very specific
circumstances. Also, while there may be a right of first sale, there
isn't a right of second sale: eBay won't let anyone resell a digital
download they bought -- so buyer beware.

Lessig's free book
still racking in the sales
Stanford Magazine carries a story this month about our chairman and
co-founder Lawrence Lessig's book
which has just entered its third printing. This is interesting because
the book is freely
available online for download (under a Creative Commons license),
and has been downloaded about 180,000 times. On the one hand an author
can give away free content for folks to remake into audio books,
translations, and other formats, and the author
still gets paid through traditional book sales. Amazing how that
works, and works so well sometimes. [via Copyfight]
It
will be very difficult to "prove" that the Creative Common license and
the freely downloadable aspect of
Free Culture improved
sales, but the book is selling and making it freely available has
clearly not STOPPED sales. I wonder if it is possible to show that
making books available for free electronically increases the sale of
real books? I wonder if there are particular genres where this holds
more true...
