01/04/2005 08:20 PMReally not quite sure what to make of this one, but it's too amusing
to pass up. Apparently, a few years ago, ESPN posted a picture of
famed daredevil Evel Knievel with his arms around two women (one of
whom was his wife) with the caption: "You're never too old to be a
pimp." Knievel, not realizing this was a (weak) attempt at
complimenting him, sued ESPN for defamation. A lower court tossed out
the ruling, and he appealed. Now the Appeals Court has ruled against
him as well, noting that, based on the context no one is actually
going to think Knievel is a "pimp," and, in fact that the statement
was supposed to be a positive one, as the slang of the day suggests.
Knievel, apparently lacking a sense of irony over this particular
case, has responded by
calling the judges
"bimbos." The full quote is: "They ruled against the law. What
good is law in the United States of America if five or six goddamn
bimbos are going to rule against it?" You think he intended that as a
compliment? Anyway, in the meantime, feel free to go on captioning
photos on the web while calling people pimps.

decision that said file sharing programs weren't liable for
copyright infringement that occurred on their networks, the Appeals
Court has
upheld the original ruling. The Reuters report only
has two paragraphs now, but I'm assuming it will be expanded with
details. Once again, it looks like the courts have been able to
understand the difference between a person doing something illegal,
and a company that provides a tool. This ruling isn't a huge
surprise, of course. During the trial, the judges made it clear they
weren't
buying the entertainment industry's version of the story, when the
judge told the RIAA lawyer: "Let me say what I think your problem is.
You can use these harsh terms, but you are dealing with something new,
and the question is, does the statutory monopoly that Congress has
given you reach out to that something new. And that's a very debatable
question. You don't solve it by calling it 'theft.' You have to show
why this court should extend a statutory monopoly to cover the new
thing. That's your problem. Address that if you would. And curtail the
use of abusive language."
