the
NorVergence scam. Basically, the company was selling some telco
equipment that was available on eBay for about $300, renaming it "the
Matrix," sending fast talking sales people in to small, non-tech savvy
businesses, and promising that the box could provide "unlimited
broadband, landline and cell phone service with no per-minute
charges." The details, of course, proved this wasn't quite true.
Also, instead of just selling the boxes, they would lease them for
upwards of $300/month for
five year leases. Then, to make the
scam even better, they sold off those leases to a variety of financial
institutions, cashing out right away. The company then proceeded to
shut down, making the boxes completely useless -- but the banks who
had bought the leases didn't care at all and still expected their
money. Thus, they started sending threatening legal letters to those
people who weren't paying -- even though none of the "buyers" were
actually receiving service. NY Attorney General Eliot Spitzer has now
convinced the banks to forgive the leases for NY
companies that had been scammed, though there are still plenty of
others. Of course, the real issue is that both the financial
institutions and the end-customers were scammed -- and the NorVergence
executives went off to start another company accused of bilking
investors out of millions before shutting down.

01/05/2004 12:15 PMI'm curious to see if anyone has noticed a decrease in the amount of
spam they receive since January 1, when the new federal spam law went
into effect. Personally, my spam levels are identical to what they
were in the month of December, suggesting spammers couldn't care any
less about the federal law. Of course, one of the (many) bad things
about the law is the fact that it wipes out a variety of (stricter)
state level anti-spam laws. I'm assuming this includes the anti-spam
law in the state of Washington that let individuals sue spammers for
$500/message. Luckily, Jim Gordon, appears to have
filed his
latest spam lawsuits late last year, early enough that the
Washington state laws still mattered. He's suing a Pennsylvania
spammer, Commonwealth Marketing Group, $500 for each of 1,200 spam
messages he believes he's received from the spammer. He sent them a
letter asking them to stop and they ignored it. The spammer's
responses are typical. First they claim the guy requested emails from
the spammer - and then add a cryptic statement: "our computers are
programmed to identify him." Next, they turns the case around and
suggest that it's really a "scam" being pulled by Gordon to extort
money out of them. The firm's CEO also claims that their emails are
completely legitimate and not misleading at all. He says this with a
straight face despite the fact that the company's owner is currently
serving a 15-month prison sentence for fraud. Apparently, the company
pitches credit cards via spam to low income people, forcing them to
buy a vacation package on the card. After they've charged the
vacation package the car has $13 of remaining credit, causing the
cards to be rejected anywhere they're used.

08/18/2004 04:26 PMAnother lawsuit has been filed against Google due to the companies
AdWords keyword advertising program. So next Tuesday Google will be
heading over to a German courtroom where it will continue to defend
its technology against Metaspinner Media GmbH.
Metaspinner claims that Google's AdWords keyword advertising program
infringes on its "Preispiraten" trademark. According to
PCWorld Metaspinner already "won a preliminary injunction against
Google last November and is seeking a permanent injunction and
damages." This isn't the first time Google has been taken to
court for similar trademark infringements. Earlier this year American
Blind & Wallpaper Factory accused Google that its search engine's
keyword-based advertising violates its trademarks.
This probably isn't the last of these types of lawsuits, eEspecially
since several companies use generic words in their names - e.g.
General Motors. Because of this, Google could also be targeted for
keyword-based advertising. For Google's ad program to be ever
sucessful, they need to resolve these issues once and for all.

01/29/2004 02:49 AMWell, that didn't take long. Less than a week after AOL paid up to
settle
the lawsuit they were dealing with over selling trademarked words
and phrases as search keywords, a company is
suing
Google, AOL and other Google partners for basically the same
thing. In this case, American Blind and Wallpaper Factory told
Google to stop selling keywords based on their trademarks. Google
told them they would stop selling on things like "American Blind
Factory" and "DecorateToday," but saw no reason to stop on such
generic terms as "American wallpaper" and "American blind." In fact,
Google went so far as to ask a judge to say this was perfectly fine.
In response, American Blind is suing them. Let's try this once again:
the point of trademark is to make sure no one is misled. That's not
what happens at all when someone is buying keywords on your trademark.
Trademarks don't give you a monopoly over the word or phrase - they
just let you stop people from confusing customers into think they're
you, or that you endorse them somehow. However, ads are clearly ads,
and targeting them at people who might be interested in your offering
(so long as they don't misrepresent themselves) is a perfectly
justifiable thing to do. It's the same thing as getting
shelf-placement near other, similar products.
