It looks like the various spam laws that help legalize spam are making the spammers extra litigious. Following a lawsuit in the US by a spammer against an anti-spam operation for still block their email, some spammers in the UK are threatening Spamhaus with lawsuits for still having them on their blacklist. The problem is that, just because the law now gives them the permission to spam, it doesn't mean people aren't allowed to make their own private efforts to block them. The laws may allow them to send their spam, but there's nothing in these laws that require people to receive it.

A few weeks ago we linked to an article from someone freaking out that (gasp!) a virus writer could release a virus from an unsecured WiFi access point and no one would ever be able to track him down. This is a bogus complaint. Most criminals try not to leave a trace of where they came from, and that's what real detective/forensics work is about: tracking them down. So, just because you can't figure out who they were because they were on an access point, you can still get clues, and let traditional detective work take over. That appears to be exactly what the FBI did to track down an online extortionist who used unsecured WiFi access points to secretly send out his demands. The FBI used other clues to figure out who the guy was and caught him that way. It's not clear why some computer security people seem to think that the only clues to computer crimes must also be on the computer.

Three years ago, a French court decided that Yahoo and it's chief executive were war criminals for allowing the sale of Nazi memorabilia on non-French websites (Yahoo did block them from Yahoo's French site). Since then, there have been a variety of appeals and discussions about juris dictional issues online, eventually leading to a ruling out of a Parisian Appeals Court today admitting that perhaps Yahoo wasn't a war criminal after all. While that (finally) does make sense, it still doesn't clear up the very big jurisdictional questions this case raised. If we're held to the standard that anyone can reach any content online, and therefore any law applies, then it will cripple the internet -- as the most stringent laws will be held to apply across the board. However, it seems like everyone is still ignoring this issue until it strikes again.
