"Yeah, getting a CD of the show you just saw is fine and all, but
putting that to shame (at least from a gadget nerds
perspective), New Jersey indie rock club Maxwells
is installing new digital kiosks that will let you download shows
directly to one of those USB keychain drives. Shows cost $10
each, with an extra $20 for the 128MB drive, and were assuming
that you can use your own drive if you have one. And whats
even better is that theyre using unrestricted MP3 files, so you
can just take the drive home with you, pop it into your computer, and
copy the show onto your iPod or share it with your

I love this idea! I went to a show at the Park West earlier this
month, and after the show I asked the sound guy if they were selling a
recording of it. He looked pretty confused by the question, so I'm
guessing this concept is still a ways out of the Chicagoland area. One
can hope for the future, though....

Pearl
Jam experimenting with offering recordings of their live shows to
fans online, and it appears that
plenty of other musicians are signing up to do the
same thing. There are a couple of interesting angles on this one.
First, it's a way for the bands to (mostly) cut out the recording
industry middlemen they have to deal with most of the time. Live
shows are how bands usually connect with fans, and this opens up those
shows to a much wider audience. At the same time, many of the bands
are choosing to offer these concert recordings without any copy
protection - and they're selling like crazy. There's a great quote in
the article from Brad Serling, who runs the site that many of these
bands are using: "The No. 1 issue that most of the music industry has
wrong is D.R.M. Why make it harder for people to buy your product?
The answer is fear, and you have to get over the fear. What would you
do if you walked into Tower Records to buy the new Dave Matthews Band
CD and the guy behind the counter said: 'Here's your CD. It's $18, but
you can only listen to it in your den on one stereo. You can't take it
to the car. You can't put it on your iPod.' You would laugh at him and
walk out, right? It's the same thing here." Offer something to people
that they want, and you'll be amazed at what they're willing to pay
for.

04/29/2004 03:41 AMBootlegging concerts has been around for ages. People would bring
tape players to shows and record them. Certain bands appreciated, or
even encouraged such recordings - with some even allowing fans to
patch into the sound board. These days, that all seems so last
millennium. Bands have already started recording their own shows and
offering to sell the CDs or downloads immediately afterwards. Now
eMusic is trying to go a step further and is actually setting up
kiosks where you can
immed
iately download the concert you just saw in MP3 format onto a USB
keychain hard drive. They say that selling CDs isn't worth it since
people just go home and rip the CDs to MP3 anyway, they might as well
give the music out in MP3 format. In fact, they encourage people to
then go and share the MP3s, pointing out that it's often smaller,
independent bands who will play these shows, and they want the
promotion (once again proving the RIAA's stance to be incorrect). The
whole thing costs $30 total: $20 for the USB hard drive and $10 for
the music. It's unclear if you can bring your own USB hard drive (or
reuse old ones) to avoid that charge, but it seems likely. Of course,
the one big downside I see with all of this is that the kiosks are
bound to be a bottleneck. If you have a few hundred people packed
into the club, and just 10% of them want to buy the keychains, that's
probably a long wait in line. Why not just
put the
concerts online and let anyone download them?

completely banned
bringing
any kind of video camera into a theater, even if you weren't using
it. As many people pointed out, this seemed to go too far - as just
carrying a video camera (especially a camera phone) doesn't mean
you're doing anything illegal with it. Well, the law went forward and
now
the
first two arrests have been made - in both cases traditional
situations where people in the audience were caught trying to record
the film on camcorders. While the actions described clearly are
illegal, it still seems like this law goes too far. In other related
news, the article mentions the sentencing of the guy accused of
putting
screener tapes online - saying that his sentencing has been
delayed six months so the studios can "calculate the losses incurred."
It's going to take six months to calculate the losses? Expect the
losses to be nowhere near reality, as they'll assume that every
potential download was a "lost sale," when that's clearly not true.
It's likely that many of the big fans of those movies went and saw it
in the theater anyway, and others never would have paid to see the
movie anyway. In fact, there's a chance that the download enticed
some people to go see the films in the theaters. But, of course,
don't expect Hollywood to take into account any of those things.

new
leader, it looks like the RIAA's grand plan doesn't include
anything that involves actually listening to what their customers are
telling them, but rather, it's all about telling their customers what
they're doing is wrong, wrong, wrong, and you should go to jail for
it. In an
interview with the
RIAA's top lobbyist, Mitch Glazier, he repeats all of the usual
RIAA lines about how important the Induce and Pirate Acts are, how he
believes they're actually winning this battle against file sharing and
how any change to the DMCA clarifying "fair use" would somehow be a
"terrible precedent." However, he makes a very telling statement when
it's pointed out to him that for each file sharing network they shut
down, another 10, with better security, better filtering and better
tools seem to spring up. His response is:
"Our job is to make the
risks high enough that fewer companies are interested in taking those
risks." Apparently, it's
not their job to see what their
customers want and actually offer that. Meanwhile, for all the
"risks" they're trying to add, plenty of others have noticed that
every one of the
RIAA's strategies so far, seems to have backfired in some manner
when it comes to file sharing.

Apparently this issue is starting to get some mainstream attention in
that there are some proposals on the table to include a rating of the
