Larry Lessig, having heard about Darl "SCO" McBride's latest missive, has dropped everything to write a scathing response.
We should all believe that the "progress of science" is best advanced when "Authors" have the right to do with their property whatever it is they want to do -- consistent with the law, and so long as the property right is properly balanced. And we should all believe that the "progress of science" is best advanced when that right is "vigorously protect[ed]".

But the owners of GPL'd software are doing no more than exercising this right, just as Microsoft would exercise its right. They are profiting from the right to choose the terms under which they release their software, and the terms they have chosen also have a great benefit to other software innovation. They exercise their property right; they and we benefit.

But if we are to protect that property right "vigorously," then we should take steps to protect property owners from baseless lawsuits against their right to use their property as they wish. So when it comes to the matter of sanctions against the lawyers in this case, the judge might well want to consider how important it is that the property right of copyright owners be "vigorously" defended.

I was reminded, as I finished the last 12 pages last night, of something I once heard or read (I'm afraid I can't quite recall the reference) about why a seemingly straight shot across an African plain winds and meanders, twists and turns. Apparently the roads are built on earlier trails used by the native population for migrating, tracking, and hunting. These, in turn, are based upon the routes of the animals--herds of Wildebeest, lumbering elephants, graceful giraffes. So, if in the middle of a seemingly unobstructed bit of road, you should come upon a sudden veer to the left or right, chances are a long time ago, on this very spot, an elephant avoided a particularly thorny bush, a giraffe noticed a more succulant tree off in the distance, or a gentle rise felt not quite so gentle to a herd of zebra under the hot African sun.

InterLink introduces cheap, easy-to-administer, single-minded authentication server with WPA and 802.1X/EAP-TLS support: RADIUS is expensive and complicated. Small businesses either can't afford the server software or the staff to support it. InterLink is trying to reduce the cost of providing a secure Wi-Fi network by introducing its LucidLink client and server software that has one. Unlike robust, multi-purpose RADIUS servers, LucidLink authenticates in one way for one purpose. LucidLink's client software manages certificates used with EAP-TLS, the most secure method of out-of-band messaging for the authentication portion of joining a Wi-Fi network using 802.1X. With EAP-TLS, the certificate on the client machine assures the server of the correct identity. LucidLink uses WPA for keying material. It supports certain releases of Windows XP and 2000. LucidLink is the flip side of the coin from Wireless Security Corporation's out-of-house solution. WSC runs its RADIUS system as a managed service over the Internet, charging $4 to $5 per user per month. InterLink's server will cost $449 for 10 users and a lower per-user cost for higher quantities, and requires a Windows 2000 or 2003 server. The client software is nominally free, but the license for users resides on the server side....
