We've written before about how civil liberties groups are suing the attorney general for a law that forces ISPs to block access to sites they decide have child pornography on them. Today, the case began, and a fairly compelling argument was made. The problem with this case is that people hear "child porn" and immediately decide that anything that stops it is good. Stopping child porn obviously is a good and noble goal - but this law doesn't do that and has a ridiculous amount of collateral damage. What the law should be, is that if a site is discovered with child porn, the site itself should be taken offline and those responsible should be tried for breaking the law. Instead, what this law does is force ISPs in Pennsylvania to block access to those sites. In other words, the sites remain online - but people using certain ISPs are blocked from accessing those sites. In cases where the site is on a shared server, every other site on that server are also blocked - even if they have nothing to do with the child porn. The Pennsylvania attorney general insists that this is the right way to go, but doesn't explain why they can't focus on catching those actually responsible for the child porn rather than using this other, ineffective and troublesome solution instead. This is the equivalent of the state discovering a crack house, but instead of shutting down the crack house and arresting those responsible, they just have the police come and put up a big barrier blocking the road from everyone - even others who happen to live on the same street. Even worse, they won't tell those who live on the street that they've been blocked or tell them why. They just stop letting them go home.

I used to think I knew what online community was all about. I thought it had something to do with discussion forums, like the one here at InfoWorld I've recently tried to colonize. Having spent too many years, keystrokes, and brain cells debating the pros and cons of various discussion technologies, I'll just cut to the chase. This WebX thing is not working for me. It's not simply that the software mangles URLs, doesn't preview messages, and handles topics and threads in a way I find awkward. What's broken, for me, is the idea that an online community is a place where people gather, and a centralized repository of the discussions held in that place. In that model, I've concluded, the costs are just too high. It's expensiv e to join. It's expensive to participate, because interactive discussion demands a lot of attention. And it's expensive to leave, because the repository has your data, and may or may not (probably won't) preserve its linkable namespace or hand the data back to you in a reasonable form. ...

As you may know, I teach each fall at the University of Hong Kong's Journalism & Media Studies Centre, helping out with a new media course led by Andrew Lih, a professor there. The student project this year is especially interesting, I think. Here's the text of a release being sent out to various folks.

Chatter Garden, an online community for news and discussion about Hong Kong regional politics and public affairs, is now live. The English language site was created as a University of Hong Kong student project for the New Media Workshop, part of the Journalism and Media Studies Centre. Visitors are encouraged to engage in online community dialogue, writing weblog entries and moderating stories. The Web site creation was directed by assistant professor Andrew Lih and visiting lecturer Dan Gillmor, author of the book, "We the Media." While Hong Kong has one of the most free media environments in East Asia and China, there are surprisingly few forums for public discourse. Chatter Garden was inspired by other online citizen journalism projects, such as OhmyNews (Korea), Malaysiakini and DailyKOS (US) to engage citizens in discussing regional public affairs. Topics include politics, economy, culture, and "One country, Two systems." Chatter Garden is named after "Chater Garden," the park next to the government Legislative Council building, and a popular gathering place for local political rallies.

Cory Doctorow: Telltale Weekly, which sells DRM-free audiobooks of public domain works, has just posted a $0.50 version of "Casey at the Bat" and two "sequels" written by a different writer, hearkening to an era when copyright didn't mean that others couldn't fool around with your work.

Ernest L Thayer (writing under the pen name "Phinn") wrote the baseball classic Casey at the Bat: "A Ballad of the Republic, Sung in the Year 1888" for the San Fransisco Examiner. In the century since, the poem has spawned hundreds of sequels, including a handful of updates by sports columnist Grantland Rice.

My Back Pages--Interesting in his own right Eyolf Østrem still maintains the fan's fan tab, chords and music site, the standard by which all others are judged. I just revisited it the other night, while trying to recall how that little run in Dylan's version of Delia went, and dang, if it didn't have the back story of that ballad. I love this kind of stuff. The source of that account, John Garst, is the folklorist king of such research--he puts John Henry at a railroad tunnel near Leeds, Alabama, just east of Birmingham on September 20, 1887, for example. Murder and heroic death ballad back stories are of extreme interest to me, so I decided to post a few more here: Frankie and Albert, Frankie and Johnny, Casey Jones and Stagger Lee.
