Can I just say this? Napster politics are brutally boring. The action right now is in making the music and video owned by the major labels and film studios archaic and unpopular. We're going to do to those properties what talkies did to silent films, what political bloggers did to Dan Rather, what Elvis did to Mantovani. Our stuff is better, that's how we're going to win.

Forcibly liberating that old stuff is a painfully stupid strategy. The more unauthorized filesharing you do, the more attention you give those old cutural fiefdoms, the more money you generate to sue you with. It is a total waste of time.

Creative Commons is of course the antithesis of forcible liberation. You can choose to participate in free culture, or not.

The legal tools and technology for free culture are loosed. Free content is burgeoning (ex: 8 3,360 licensed tracks on Soundclick, now).

As many others have pointed out, the immediate challenge is discovery. Who will be our Elivses? Who will find and promote them?

By the way, a Mantovani fan site. No disrespect intended, you just may not have heard of this great star of pop music, pre-Rock'n'Roll.

A while back we talked about a grilled cheese sandwich with the image of the Virgin Mary on it, which sold for $28,000 on Ebay. Today I heard a story on the radio about Miles Bradley, an antique dealer in Chamberlain, SD — just down the road a piece — who found a Wheat Thin cracker with a likeness of Elvis' head on it. Or so some say. I just don't see it. Bradley tried to repeat the grilled cheese success & cash in on his find by selling it on eBay.

Apparently I wasn't the only one who failed to see The King on the cracker. (Take a look at the pictures on the auction site & let me know what you think.) The bidding failed to break the $500 reserve price, and the auction closed with a high bid of $451. The disappointed Bradley is reportedly going to give it another shot, but if it doesn't break the $500 reserve this time, he's gonna eat it. He probably should've done that to begin with.

If it were me, after going to the trouble of listing it on Ebay, I would've taken the $451 and run.

Don't miss "Stingray" Elvis's version of American Trilogy: Link to video (MPEG-4, 5.5 MB). I think my favorite is Bibby Simmons aka Black Elvis, from Alabama. His website has as many excellent blinking gifs as his cape does sequins, and you can download some of his MP3s here for free. I don't see Thai Elvis in here, but he's just a few miles away from me here in Hollywood, at Palms Thai restaurant.

Also, apropos of nothing: before I discovered the glamorous world of blogs, I once wanted to be a linguist. I studied a number of languages, including some "endangered" languages, because I thought they were beautiful like code. I studied Lakhota ("Sioux") for a while with an indigenous linguist who was born on the Pine Ridge reservation. One of the only words I can still remember is "igluchanchalowan." My teacher told me that translated literally it means, "he who gyrates," but it's the Lakhota word for "Elvis Presley."

Last Wednesday, I had the awesome session for Super Robot Monkey Hyper Force Terriffic Mega Madness Hella Hella Bitchin GO! That session led to an audition on Friday for the freakin' head of voice over casting at Disney Feature Animation for a new Disney project. If I book that job, I'll be one of two leads on the show!

On January 1, 2005, Elvis Presley's "That's All Right" -- a 50-year-old tune currently enjoying the #3 chart spot in Great Britain -- will enter the public domain.
Anyone will be able to release it without paying royalties to the owners of the master or the performer's heirs. BMG will start losing a significant piece of its catalog income in Europe. As "That's All Right" is being hailed by some as the beginning of rock 'n' roll, the implications are that every year after 2005, more recordings that defined the genre will fall into public domain.

The Index for Free Expression has a great article on the proposal to extend the European copyright on performaces for another 20 years, and the disaster this presents for the freedom of expression:
Faced for the first time with losing significant back catalogue profits, the industry is lobbying to change the law. The industry describes the law as a "loophole". In fact it is anything but.

For every one recording that has the power to reach number three in the commercial charts fifty years after its original release, there are hundreds if not thousands of tracks that do not.

Although these recordings no longer have any commercial value to their rights holders, they are of tremendous value in terms of our cultural heritage. But the mechanisms of copyright law mean that, should the European Parliament choose to heed the music industry, keeping Elvis out of the public domain for a further 45 years or even more, the King will drag down with him this huge body of commercially worthless but culturally significant work.

Along with driving, hiking, and jogging, snow shoveling is an activity that benefits from time-shifted audio content. According to News.com, we're officially at the 10-year anniversary of electronic commerce, as defined by the first secure transaction on NetMarket, on August 11, 1994. The folks at the Internet Shopping Network disagree, claiming they started a few months earlier. Of course, it all depends on how you define "e-commerce." This article seems to define it as a secure, web-based transaction. However, even before these started showing up, I remember purchasing CDs from CDNow and CDConnection using telnet in either 1993 or early 1994, and I'm sure plenty of others could make claims to earlier "online" purchases. It certainly wasn't secure, but who was worried about security back then? Of course, it doesn't really matter when e-commerce really started, but it is amusing that no one seems to remember those pre-web offerings.
