system using a Wi-Fi connection from the parking lot of one of the
stores: They're accused of changing files, stealing credit card info
and installing malicious software. TechDirt wonders if those
accusations are unfounded and if the press is going to have a field
day with this. I do too....

un-secured hotspots and sending spam from the open connections: The
original story here is one of those infuriating reads that doesn't
mention how the guy got caught. It seems that historically people who
have gotten caught for improperly using hotspots have done so by being
stupid or unlucky. It's otherwise difficult to track someone down
especially if they move around a lot looking for insecure hotspots....

TOKYO - Tokyo police sent papers to prosecutors Thursday on a
businessman over use of the U.S.-made Segway scooter vehicle on a
public road, an unusually strict move that marks the first time in
Japan that police have taken action over people riding the two-wheeled
novelty.
The police allege that the 42-year-old president of an import
company in the capital's Setagaya Ward violated the Road Traffic Law
by having a person drive a Segway on a public road in July last year
for advertising purposes.
Last year I tried to get the
government to relax its regulations to allow people to ride Segways,
but they wouldn't. I gave up the idea. I actually know this guy and he
was insistent that he could build a business importing Segways. I
guess not. This is pretty "unusually strict" but the police hate it
when you make money doing stuff that they don't approve of.

being arrested for selling thousands of dollars worth of fake online
coupons has me a bit confused. The woman says she stopped as soon
as she found out it was illegal - which raises a bunch of other
questions not answered by the article. Was she creating the coupons
herself? If so, then she must have known it was illegal. If not,
where were they coming from? The article does mention that her
husband was charged with "forgery, fraud, theft and other crimes," so
it's possible that he was creating the fake coupons and giving them to
her to sell. Still, you might think she would have asked where they
came from. Of course, I also wonder
who buys coupons? I
always thought coupons were the things you got for free with the
Sunday paper.

published a story regarding Diebold's alleged use of uncertified
voting software in violation of California state law (Diebold knew of
legal risks). The article cited and focused on internal legal memos
from the Jones Day law firm showing that Diebold's own lawyers had
warned of some of the possible illegalities. Online, the Oakland
Tribune posted the documents in addition to the article. That
afternoon, the Trib's parent company and the reporter were sued by
Jones Day to have the documents returned. The judge ordered the
documents returned, except for those already published on the internet
(Judge: Tribune must turn over legal memos):Hmm, "already published on

criminal copyright infringment, the result of an investigation that
involved a USA PATRIOT Act warrant against the site's ISP to gather
intelligence. The Feebs confiscated and then destroyed his personal
computers, returning their remains months later. All this comes after
several of the show's cast and creators have made a special point of
saying how much they liked the site. The site owner lives in Ohio, but
has been charged in LA and needs money to get to the coast and defend
himself; they're raising money through t-shirt sales and could use
your help.
Adam was first tipped off about the investigation when the FBI raided
his and his fiancee's apartment in May of 2002 and seized thousands of
dollars worth of computer equipment. Adam later received a copy of the
affidavit filed in support of the search warrant, and was shocked to
discover that this document, prepared by the FBI, contained
significant amounts of erroneous and misleading information. For
example, two social security numbers were listed for Adam, one of
which is not his. References were made to a cease and desist letter
sent by the MPAA to an email address that did not exist. His online
friendship with other Stargate fans across the globe was portrayed as
an international conspiracy against the MPAA. And perhaps most
disturbing of all, it was later revealed that the FBI invoked a
provision of the USA Patriot Act to obtain financial records from his
ISP. The FBI's abuse of its powers did not stop there. When they
seized Adam's computer equipment, he was given written documentation
stating that it would be returned within 60 days. The equipment that
they did return did not arrive until more than 8 months later, and
only then after much prodding from his lawyer. Much of it was damaged
beyond repair - one laptop had a shattered LCD screen, an empty tape
backup drive was ripped apart for no apparent reason, his fiancee's
iBook was badly damaged when it was pried apart with a screwdriver.
The FBI's computer crimes staff is either incompetent (at least when
it comes to Macintosh computer equipment) or else they just don't give
a damn.
