03/08/2004 11:04 PMThis is not the first time it's been noted that sending in the lawyers
to try to "disappear" information a company (or individual) doesn't
like tends to have the opposite results. Remember Barbara Streisand
trying to stop a photographer documenting coastal erosion from posting
a photo of her property? Prior to that, very few people noticed the
site. After the lawsuit began
many
more people went and saw the photo. The same sort of
thing appears to be happening with Infinium Labs and HardOCP. While
there was mumbling in the gaming community that Infinium's Phantom
gaming console
didn't
really exist, not too many people were paying attention. In fact,
by
hiring
a respected CEO the company was gaining credibility. However, now
that they've been tangled up in a lawsuit for threatening HardOCP for
an article that was six months old and pretty much off everyone's
radar screen,
the
questions raised by that article are suddenly getting a lot more
attention. While the lawyers may think it's best to sue, the
internet makes it very likely that any lawsuits (or even threats of
lawsuits) pretty much guarantee that they'll be giving whatever
content they want hidden even more attention. Someone should sit some
of these lawyers down with some PR people and review each and every
case where this has happened.

who sued Microsoft for its predatory behavior against California
customers are doing their best to fuel the public's contempt for the
legal profession.
They're asking for more than $250 million in
fees, as the AP reports today -- "about $3,000 per hour for one
lawyer, more than $2,000 an hour each for 34 other attorneys and
$1,000 an hour for administrative work."
This is beyond absurd. We get ripped off once by Microsoft, and now
the lawyers -- whose deal with Microsoft gives precious little
individual customers -- are bellying up to the trough in ways that
would embarrass anyone who had an ounce of shame.
The judge in this case should say no. Give the lawyers a reasonable
fee, not this grotesque lottery score. It's the customers who deserve
most of that money.

07/15/2004 02:00 PMI would really like to believe that not all PR people are this bad,
but I'm beginning to lose faith. Last year, I wrote up a longer piece
about
PR
people who don't understand blogs and tried to do things like
trick bloggers into writing about the companies they
represented. I mentioned, in passing, that some PR people submit
press releases to the site, even though we clearly say not to do so.
I can certainly understand it if a PR person didn't happen to catch
that post. However, if you're going to be in PR, and you're going to
try to get blogs to write about the companies you represent, we should
set some ground rules.
First: Read the damn site. If we
never talk about highly technical things like a new computer
fan,
do not try to get us to write about a new computer fan.
You're wasting our time, your own time, as well as the money of the
company you represent.
Second: Read the damn
submission page. If
you're not going to understand what the site is about, at the very
very least (we're not asking for much) you could read the page where
you submit the press release, because it says (in bold) not to submit
press releases. If you can't even bother to read that page, why
should we bother to read your press release?
Finally: If you're
going to ignore both of these fairly simple rules,
do not then
claim on your own website that you are somehow "A High Tech PR Agency"
or that you have "the broadest high tech PR experience of any Public
Relations Agency." It's not true. If it were true, you would know
not to do what you keep doing. Also, don't claim that you "did online
PR before the Internet." You didn't. The internet was there before
you were. This isn't difficult, but bloggers are not traditional
press. While some of them may accept press releases, the fact that
you can't bother to take the briefest amount of time to figure out
what kind of publication we are suggests you're not so tech savvy
after all.

Windows that you overpaid for? Well, it looks like those lawyers
will have to settle for a bit less. Rather than the $286 million, a
judge has ruled that
they'll only get $112.5 million. Of
course, that means more of the settlement money is available to anyone
who bought Microsoft products in California and
fills out
the claim form. Amusingly, I just tested out the claim form and
found that, at least on this computer,
it didn't work in
