Copyright, Technology, and The New
Surveillance

Copyright, Technology, and The New
Surveillance
04/28/2004 06:52 PM
Sonia Katyal at Fordham Law School has written a very interesting paper on the relationship between copyright enforcement and privacy in the digital age, with focus on the increasingly invasive methods that rightsholders use to control how intellectual property is accessed and shared. Excerpt:
A few years ago, it was fanciful to imagine a world where intellectual property owners - such as record companies, software owners, and publishers - were capable of invading the most sacred areas of the home in order to track, deter, and control uses of their products. Yet, today, strategies of copyright enforcement have rapidly multiplied, each strategy more invasive than the last. This new surveillance exposes the paradoxical nature of the Internet: It offers both the consumer and creator a seemingly endless capacity for human expression - a virtual marketplace of ideas - alongside an insurmountable array of capacities for panoptic surveillance. As a result, the Internet both enables and silences speech, often simultaneously.

This paradox, in turn, leads to the tension between privacy and intellectual property. Both areas of law face significant challenges because of technology's ever-expanding pace of development. Yet courts often exacerbate these challenges by sacrificing one area of law for the other, by eroding principles of informational privacy for the sake of unlimited control over intellectual property. Laws developed to address the problem of online piracy - in particular, the DMCA - have been unwittingly misplaced, inviting intellectual property owners to create private systems of copyright monitoring that I refer to as piracy surveillance. Piracy surveillance comprises extrajudicial methods of copyright enforcement that detect, deter, and control acts of consumer infringement.

Ms. Katyal's paper was selected as the winning entry for the 2004 Yale Law School Cybercrime and Digital Law Enforcement Conference writing competition. Link< /a>

Net-Parazzis: Copyright violation as
business opportunity

Net-Parazzis: Copyright violation as
business opportunity
03/14/2005 05:44 PM

Apparently, catching copyright violators is becoming a profitable business in Korea.  So called Net-parazzis (Net + Paparazzi) are prowling the Net in Korea to catch unsuspecting copyright violators anyway they can in return for a cut of the financial settlement between the copyright violator and the copyright holder.

One Net-parazzi business found 18,000 violators in the past 8 months.  Settlement fees range $500~$1000 for adults, $300 for university sutdents, and $100 for minors.  With split of 40% for Net-parazzi, 40% for the lawyers, and $20% for copyright holders, Net-parazzis are making decent profits.  So far there are 10 such companies but the number is expected to grow rapidly because Korea is full of smart net-savvy yet jobless youngsters.

US Supreme Court to consider major
copyright and technology case

US Supreme Court to consider major
copyright and technology case
12/17/2004 06:30 PM

The United States Supreme Court agreed to consider a high profile case involving the internet and copyright infringement. The question, which has been subject to numerous lower court rulings, concerns whether or not the creators of peer-to-peer software can be held liable for users' copyright infrigement. The companies cite the 1984 " Betamax case ," which immunized VCR makers from copyright charges. The intellectual property holder side of the case charges the software companies with knowing full well the uses to which their applications have been put.

Metro-Goldwyn-Mayer Studios v. Grokster Ltd involves a large group of players:

The large group of plaintiffs includes the Motion Picture Association of America, the Recording Industry Association of America, Warner Brothers Entertainment Inc. and a class of 27,000 music publishers and songwriters. The Supreme Court will hear the case in March and is expected to decide it by late June.

OK here is some good news from the digital divide that puts some of the tech industries biggest players on the side of consumers in supporting the Digital Media Consumers' Rights Act which is also referred to HR 107 which I have been advocating that you support. I am continuing to encourage you to write to your Congressional Representative to help get this bill approved. HR 107 will change wording in the Digital Millennium Copyright Act that will assure consumers fair use of digital media.

Of course the MPAA, RIAA and other organizations want those provisions of the DMCA that HR 107 changes left as they are so that encryption and lockout tools can be incorporated into digital recording devices.

It is nice to see public companies working behind the political scenes in Washington DC forming a coalitions that supports the consumer. [Cn et]

TRANSCENDING THE TECHNOLOGY CONSTRAINTS
TO RAPID BUSINESS GROWTH: How Emerging

Internet Business Systems to Improve
Profits and Manage Change While Reducing
the Costs and Risks of Expansion
06/23/2004 03:08 AM
It’s a myth that the information technology (IT) requirements of emerging and midsize businesses are simpler than those of large enterprises. Virtually every day, we interact with the technology and business leaders of midsize companies whose IT demands not only rival the requirements of much larger companies, but in many cases exceed them.Fortunately, emerging and midsize businesses can resolve the dilemma of updating their outmoded IT infrastructure without massive one-time investments in technology. New technologies, such as Microsoft® .NET, enable companies to leverage previous investments in technology while step-by-step integrating their business systems to enable an efficient, cost-effective, and flexible solution to driving and managing growth.
