I walked out of my constitutional law class, climbed into a car to go
to a plane to fly to Chicago to fly to Sao Paolo to fly to Porto
Alegre to get into a car to come to this. Brazil is hosting the
World Social Forum, and Barlow and I will be on a panel
with Manuel Castells and
Gilberto
Gil on Saturday. But Thursday night, we visited the
Youth Camp, which in
part this year is devoted to demonstrating and developing tools to
support free software and free culture.
We arrived in the middle of a concert. Gil was asked to speak. As he
went to the mic, the tent fell silent. Hundreds were packed into a
tiny space. Gil began to describe the work of the Lula government to
support free software, and free culture, when a debate broke out. I
don't speak Portuguese, but a Brazilian who spoke English translated
for Barlow and me. The kid was arguing with Gil about free radio. Two
minutes into the exchange, about 8 masked protesters climbed onto
chairs on one side of the tent, and held posters demanding free radio.
A huge argument exploded, with the Minister (Gil) engaging many people
directly, and others stepping in to add other perspectives. After
about 20 minutes, the argument stopped. The band played again, and
then Gil was asked to perform. For about another twenty minutes, this
most extraordinary performer sang the music he's been writing since
the 1960s, while the whole audience (save Barlow and I) sang along.
When the concert was over, Barlow, Gil and I were led out of the tent.
It was practically impossible to move, as hundreds begged Gil for
autographs, or posed for pictures. At each step, someone had an
argument. At each step, Gil stopped to engage. Even after Gil was in
the car, some kid rapped on the window, yelling yet another abusive
argument. Gil, with the patience of a saint, opened the window, and
argued some more.
This was a scene that was astonishing on a million levels. I've seen
rallies for free software in many placed around the world. I've never
seen anything like this. There were geeks, to be sure. But not many.
The mix was broad-based and young. They cheered free software as if it
were a candidate for President.
But more striking still was just the dynamic of this democracy. Barlow
captured the picture at the top, which in a sense captures it all.
Here's a Minister of the government, face to face with supporters, and
opponents. He speaks, people protest, and he engages their protest.
Passionately and directly, he stands at their level. There is no
distance. There is no "free speech zone." Or rather, Brazil is the
free speech zone. Gil practices zone rules.
Even after the speech was over, the argument continues. At no point is
there "protection"; at every point, there is just connection. This is
the rockstar who became a politician, who became a politician as a
rockstar.
I remember reading about Jefferson's complaints about the early White
House. Ordinary people would knock on the door, and demand to see the
President. Often they did. The presumption of that democracy lives in
a sense here. And you never quite see how far from that presumption
our democracy has become until you see it, live, here. "This is what
democracy looks like." Or at least, a democracy where the leaders can
stand packed in the middle of a crowd, with protesters yelling angry
criticism yet without "security" silencing the noise. No guns, no men
in black uniform, no panic, and plenty of press. Just imagine.

overturned significant
portions of the FCC's Triennial Review order from last year. So,
essentially, we now have FCC Chairman Powell's policies for today's
networks, and Commissioner Kevin Martin's policies for
tomorrow's. This makes things even worse than before.
The best argument one could make for the majority's decision was that
UNE-P would foster some competitive entry in the absence of
line-sharing (which Powell wanted to keep) and open fiber
networks. The best argument for Powell's view (which I
reluctantly supported) was that the broadband fight was what really
mattered, so we can afford to let UNE-P die. For now, at least,
the DC Circuit has given us the worst of both worlds.

its second piece of short fiction, "Shibuya no Love" by Hannu
Rajaniemi, a Finn living in Edinburgh. The story deals with "Quantum
Lovegety" technology, and is jam-packed with eyeball kicks and
gracenotes.
The boy looked like a painted little satyr: silver lips and eyelids,
orange ash-streaked hair and a heavy gold chain around his neck. He
couldn’t have been older than twelve, but then in Shibuya a
fifteen-year-old was ancient and venerable. The drone of the bass beat
that seemed to permeate everything in 109 obscured the rapid-fire
exchange between Norie and the boy, but it wasn’t long before he
smiled hungrily and held his palm out towards Riina, the little pink
thing bright against his dark skin like a tiny flower. She took it,
and it was still warm from the boy’s hand, a living thing
almost. Her MasterCard thumbnail sang an inaudible song to the
boy’s account, and suddenly she was the proud owner of a quantum

virtual worlds, but there are also plenty of economic issues (which
often are related to the legal ones). Wired News is running an
article looking at
some of
the economic info available about various online games and comes
to the conclusion that the only thing that really matters is if the
game is still enjoyable to its players (which seems fairly obvious).
It's not important that a virtual economy be a "successful" economy in
the traditional sense as long as it's fun for the players. Of course,
a disastrous in-game economy isn't going to be that much fun, which is
why many more games (usually from the smaller online gaming companies)
are paying a lot more attention to the in-game economic situation.

11/13/2003 02:55 PMJust in dealing with websites there have been all sorts of legal
questions about jurisdictions and do offline laws apply in an online
world. Now the issue is becoming even more complex as more and more
"virtual world" games are showing up - and actions in those virtual
worlds may seem very much like actions in the offline world. So the
question is whether or not those actions are just "part of the game"
or are they real actions with legal consequences. It's a very fine
line. We had mentioned this issue
a
couple months ago, but now some folks are holding
an entire
conference focused on the legal questions presented by online
gaming. Some think that the virtual worlds will be a good
"testing ground" for new laws and rules that could be applied in the
real world. However, others are simply focused on how offline laws
carry over into the online virtual worlds. If someone steals from
you, is it theft? If someone defames you, can you sue? The biggest
issue, it seems, is when real world money crosses over into the
virtual worlds. Once money gets involved, so does the law - which
could present problems for the crop of new games focused on bringing
in real money. In many cases, it seems that the company creating the
virtual world really is that world's government - and they make the
laws that apply within the sandbox of the virtual world. Still, many
people will undoubtedly try to pull things out of that sandbox and
into the very real world court system.

from The National Aeronautics and Space Administration (NASA) earlier
this month to develop their PC/PS2/Xbox game, Space Station:SIM, due
for consumer release this Christmas season. The Space Act Agreement is
a continuation of one received by GRS Games before Vision Videogames
management bought out the company in March 2004. It allows Vision
Videogames a flow of information from, and access to, NASA personnel
so the company can gather information to build their game. “The game
has captured everyone’s imagination. We have individuals and
international agencies including JAXA (The Japanese Space Agency)
volunteering to help us with drawings, science, music – anything you
can imagine,” says company president Bill Mueller. In Space
Station:SIM, the player assumes the roll of the Chief Administrator of
