ground" to the file sharing mess. As with many middle ground
solutions, there are things with this that are likely to upset either
side, and I'm not sure there's much to be thrilled about either.
Basically, it's just taking a Creative Commons style approach (where
the copyright owner has the right to clearly define their rights over
the song) and combines it with a directory/database system like the
DNS system. The idea, then, is that you could query the directory to
easily figure out the rights on certain songs. As an application of
this, he suggests someone could make an RSS/BitTorrent feed of good
songs that are free for non-commercial use. The one benefit I see is
that this does offer a better way for musicians to promote new tracks
that they're making available for free, as it becomes a central place
to make such an announcement (and that, alone, could actually
encourage more musicians to make their songs available). Other than
that, though, it does little to satisfy either side in the debate.
The RIAA has shown that they have little to no interest in any
discussion that involves anyone ever giving out songs for free, and
most file sharers just want to listen to music and not have to worry
about any kind of digital rights.

08/13/2004 12:47 PMThere seems to be a great confusion out there in the world of armchair
critics *cough*slashdot*cough* about what is actually being broken in
the latest Great AirPort Express hack... so, here' s my attempt at
summarizing (and simplifying) what's going on, based on what I
understand.
In the ideal scenario as envisioned by Apple
engineers and lawyers...
Step 1: iTunes decrypt songs purchased
from iTMS. This step is omitted if the songs are not protected (e.g.
MP3s that you rip from your CDs.)
Step 2: iTunes encrypt the
output from Step 1, using a "secret" algorithm so that only AirPort
Express know how to decrypt.
Step 3: iTunes send the output from
Step 2 to AirPort Express.
Step 4: AirPort Express receives the
output from Step 3 from iTunes.
Step 5: AirPort Express decrypts
the output from Step 4, using a "secret" algorithm.
Step 6:
AirPort Express send the output from Step 5 to your speakers.
Now, what was broken? Only Step 2. Which means that other
applications besides iTunes can now encrypt audio streams that the
AirPort Express will decrypt will play.
Please note that the
decryption algorithm in Steps 1 and 5 are not broken in this hack. So
this hack is not about removing the DRM protection in songs protected
by iTMS (i.e. Step 1), nor is this hack about allowing other devices
or applications to hijack (and play or record) songs that is meant for
AirPort Express (i.e. Step 5).
Having said that, everyone is
still expecting Apple to come down hard on this hack.
(P.S. Yes,
I know I'm simplifying a little. It's not the algorithm that is
"secret", but the public and private keys.)
(P.P.S. I am no
expert on this, so please do correct me if I've gotten anything wrong,
or if someone else has a better summary.)

12/19/2004 03:18 PM Misreporting abounded today about the FCC's air-to-ground wireless
spectrum decision: What really was decided in order FCC 04-287? That 4
MHz in the 800 MHz band designated for commercial air-to-ground use
will be auctioned. More on how the auction will be decided in a
moment. Reports were all over the board in describing the decision,
however, partly because of the way in which the press release was
written. If you don't know spectrum, as many business reporters still
do not, then you can easily misunderstand what was covered. Many
articles stated that the decision would allow Wi-Fi on board planes.
But that decision was made years ago, and is why Connexion by Boeing
is allowed to operate using Wi-Fi for its satellite-to-air service.
For instance, this Reuters story incorrectly states, The U.S. Federal
Aviation Administration (FAA) forbids the cabin use of devices that
intentionally emit radio waves during flight -- like wireless phones
and computers that can communicate with each other. The trade press
tended to handle this better. For instance, Stephen Lawson from IDG
News Service, a man who has filed hundreds of stories that I've read,
got his facts dead right. Mike Masnick also figured out what was
decided, but even he errs in reading the order to indicate only data
services are at stake. The two licenses the FCC will grant at auction
cover voice, data, broadband Internet, etc., although not ancillary
services which isn't defined, but which means using the frequencies
for purposes other than air-to-ground, like filling in empty spaces in
ground cellular coverage. I spoke briefly to Connexion by Boeing's
Sherry Nebel today to help clarify what was decided. Stating
Connexion's general position, she said, "The FCC did a really thorough
job of listening to all of the interested parties and addressing a
complex situation. We are pleased that the license will be limited to
the intended air-to-ground use and ancillary use will not be allowed.
And we now look forward to reviewing the commission's ruling in
detail." There's that ancillary use again--we'll certainly hear more
about it in the future. Nebel confirmed that Connexion will evaluate
all of its options, now that air-to-ground is on the table. Reports
have indicated that Connexion pays hundreds of millions of dollars a
year in fees to lease the network of satellite transponders necessary
to provide the extensive coverage needed for over-water routes. Adding

it was within someone's rights but so technically complicated it was
basically impossible anyway. Regardless, George Hotelling, who brought
the First Sale Doctrine into the online music debate, has sold a song
he purchased through Apple's iTunes Music Store. The only way to
legally transfer ownership of the song also required transferring
ownership of the entire account.
