Judge Says No More DMCA Subpoenas For
RIAA
Judge Says No More DMCA Subpoenas For
RIAA
12/19/2003 01:03 PMOkay, okay, I'll post the story of the morning.
Everyone has
been submitting the fact that the three judge panel in the Court of
Appeals has decided that the RIAA
doesn't have the right to subpoena internet providers for names
of file sharers. They actually read through the DMCA and realized
that it was only supposed to apply to people
hosting content on
the service providers computers - and not accessing the internet via
the service providers. The ruling basically says, "well, the DMCA
didn't realize that there was the possibility of file sharing and
doesn't cover it." One judge even states that the RIAA's claim
"borders upon the silly." Of course, what this probably means is that
the RIAA's lapdogs in Congress will quickly pass an amended DMCA which
includes a provision for file sharing. Of course, opening up the DMCA
for discussion might be dangerous, as it's possible that some others
might push for things to go in the opposite direction. Still, it's
good to see that a few judges seem to actually get what's going on.
This
overtur
ns the earlier District Court opinion concerning Verizon that
started the whole subpoena craze, and now makes it a
good sign
that the similar SBC case
was
moved to the same District Court who now has some more "guidance"
from above.
Update: Here's the
full decision (pdf format).

How Big (Or Small) Was The Verizon Win
Over RIAA Subpoenas?
12/22/2003 04:09 PMWhile lots of people were celebrating on Friday when the Appeals Court
overturned the rulings against Verizon and said that
the RIAA
had to file lawsuits before they could get subpoenas for customer
info from ISPs, many people were realizing that this wasn't that
big a victory. Lots of us expect that the RIAA will just get its
friends in Congress to amend the DMCA to change the law to include
these types of subpoenas (though, I still think opening up the DMCA
for amending is a risky thing for them to do, as it could backfire on
the RIAA). Others point out that all this really means is that
the RIAA will now
file John Doe lawsuits first, which will compel the ISPs to reveal
the names anyway. The difference here, though, is that the RIAA can
get in a lot more trouble if it comes to light that they're filing a
number of frivolous lawsuits, rather than just filing bad subpoenas.

02/12/2004 11:28 PMLast week, the US Attorney's office filed numerous subpoenas
concerning a November Anti-War forum held at Drake University. The
university, the leader of the Catholic Peace Ministry, and at least
four participants received the subpoenas, according to the New York
Times story. The justification supplied by the US Attorney's office
was that the subpoenas were part of an ongoing incident involving an
activist who scaled a fence at a Iowa National Guard facility a day
after the meeting, during a protest.

Nashville Screenwriters Conference
06/09/2004 04:35 AMBridging the distance between the Hollywood film industry and the best
new screenwriters across the country, the Nashville Screenwriters
Conference announces its first National Screenplay Showdown. After six
years of presenting the best writers and filmmakers in the
entertainment industry at the Nashville Screenwriters Conference, the
organization has teamed up with Ed Rugoff from the prestigious
Chesterfield Writer’s Film Project to give aspiring screenwriters an
opportunity to take their work west – all the way to Hollywood. The
Showdown evaluates screenplays solely on the basis of story-telling
ability, meaning that all genres have the same chance of winning. The
winning screenplay writers will find themselves in front of the most
prestigious literary agencies and management companies in
consideration for representation. [PRWEB Jun 9, 2004]
