Some land problems
04/01/2005 04:49 AMMy post last month about free land, Get yer free land!, has landed
(har har) me in a tricky spot. I now seem to be the fifth Googe
response for free land which is leading to strange emails from people.
Two excerpts:
I would like to request more information about the free land. I'd like
too know how I could get in on it also.
And today's missive, with (I hope) some typos:
would love to move from calif to on of the places that has free land .
But i have quistions like I have two foster bays I need to know what
that county would give to them to live on. The other thing is do they
have places to rent until you build. the other is could you place a
mudular or moble home on the land to live in while you get a job and
you feel me.
I updated the post. I don't know about the free land, I only link to
it. And I don't want to feel anyone.

EFF suing on JibJab's behalf for "This
Land is Your Land" parody
08/02/2004 03:02 AMEFF has taken things one step further with JibJab and their endangered
political parody of This Land is Your Land (Woody Guthrie's copyright
holder has threatened to sue them for their work).
We're bringing the fight to Guthrie's rightsholders, and suing on
JibJab's behalf, "to defend JibJab's fair use and free speech rights."
Check out Donna's excellent and heavily linked post for more.

EFF defending creators of This Land is
Your Land parody
07/29/2004 06:53 AMI'm proud to relate that EFF is representing Jib Jab, the creators of
the wonderful "This Land is Your Land"
Flash parody that aroused
the ire of the holder of Woody Guthrie's copyrights and resulted in a
threatened
lawuit. Here's a little bit of my cow-orker Fred von Lohmann's
letter to the copyright-holder's lawyers.
In your July 23 letter, you contend that "This Land" offers no
"satirical comment" on the Guthrie original. You are mistaken.
While your view of Guthrie's "This Land is Your Land" as being
predominantly about "the beauty of the American landscape" and "the
disenfranchisement of the underclass" is interesting, most Americans
think of the song as an iconic expression of the ideal of national
unity. Jib Jab's parody addresses, among other things, the lack of
national unity that characterizes our current political climate
(ending with the optimistic hope that unity might be rediscovered). In
short, "This Land" explores exactly the same themes as the Guthrie
original, using the parodic device of contrast and juxtaposition to
comment on the original. See Abilene Music v. Sony Music
Entertainment, 320 F .Supp.2d 84, 90-91 (S.D.N.Y. 2003) (emphasizing
the role of contrast and juxtaposition as parodic devices). The
parodic comment takes on an additional dimension of irony when viewed
in light of the often omitted closing stanzas of Guthrie's original.

04/30/2004 03:30 AMMicrosoft has released details about a number of problems which could
be dogging those who install one of its patches issued on April 13 -
the patch that fixes 14 vulnerabilities, among them two which are now
being actively exploited.
In one case, the company said that those who were running Windows
Server 2003 could experience a situation "where programs that use
Microsoft Windows Graphics Device Interface (GDI) functions to open
enhanced metafile graphics files (also known as EMF image files) do
not correctly display EMF image files that were created in Adobe

Did Microsoft Pay $12.75 Million To
Opera To Settle Interoperability
Problems?
05/24/2004 12:27 PMBack in 2001, there was a big stink when people realized that anyone
visiting MSN with an Opera browser were told that they needed to
"upgrad
e" their browser to IE in order to view the page. People
immediately (and perhaps rightfully so) started accusing Microsoft of
unfairly leveraging their monopoly power to shut out a perfectly
reasonable (and more standards compliant) Opera browser. Last week,
Opera put out a short press release saying that they had received
$12.75 million to settle a problem, but didn't indicate from whom.
Now, people are starting to say that
it was Microsoft, paying off Opera
to avoid a lawsuit on the issue - which, to this day, they insist was
simply a programming error, and not an attempt to get Opera users to
switch to IE.

This Land Is Your Land
This Land Is Your Land
11/12/2003 01:30 PM Vanished America If you've ever wondered what to do with all of
your old vacation photos and slides, wonder no more. A fellow named
Charles Cushman bequeathed his collection of over 14,000 slides and
photos taken over a period of three decades, from 1938 to 1969, to
Indiana Univiersity. IU has decided to create
an amazing
digital archive of his photos as a history project.
The photos are nothing special in themselves. He took countless
pictures of things he and his wife saw as they took driving tours
across the United States, mostly near their home in Chicago and in the
West. They are no different than and no better than anybody else's
amateur photos. But, as the director of the project points out,
without realizing it, Cushman captured an America already beginning to
disappear in the middle of the 20th century, and did so by documenting
its disappearance unwittingly over a thirty-year period. I lightly
perused the
slide show of 120 images and the photos are indeed both
banal and compelling all at the same time. A very nicely done site
with a lot of rich material.

Cirque de Sore
Legs may have won the people's choice award, but the competition
[including a giant poodle, a bird's nest, and Kafka
mid-metamorphosis] wasn't half bad. Baltimore's annual Kinetic
Sculpture Race, an unholy amalgam of engineering and art, occurred
last week. Created by
Hobart Brown in 1969, kinetic sculpture
races require participants to build human-powered vehicles that can
traverse a racecourse over land and sea, not to mention mud and sand.
And they have to do it in style. Don't live near the Chesapeake?
Then visit similar races in
Arcata,
Boulder,
Ventura,
Corvallis, and even
Perth,
Australia. Too tame for you? Perhaps you'd like to try a
flugtag or the
Providence or
Bognor birdman competitions.
