Petition against the Canadian DMCA

Petition against the Canadian DMCA

Petition against the Canadian DMCA 04/23/2004 01:34 AM

There's a petition against Canada's proposed DMCA-like copyright law up at the Digital Copyright Canada Wiki:

We, the undersigned residents of Canada draw attention of the House to the following:

THAT the Copyright Act is properly recognised as being a careful balance between the rights of creators and the rights of the public (including viewers, readers and listeners);

THAT the Supreme Court of Canada unanimously affirmed this view in CCH Canadian Ltd v Law Society of Upper Canada;

THAT digital technologies have recently given copyright holders the ability to upset the balance in the Copyright Act by preventing Canadians from accessing works for purposes that have been legally granted to them;

THAT the creation of original works is nourished by wide accessibility of earlier works, including a vibrant public domain;

THAT dissemination of cultural ideas requires that they be preserved in a form that is accessible to future generations; and

THAT historically, consultations regarding changes to the Copyright Act have mostly taken place with creators, intermediaries and only some special users (such as educators and librarians)

THEREFORE, your petitioners call upon Parliament to ensure generally that users are recognised as interested parties and are meaningfully consulted about proposed changes to the Copyright Act and to ensure in particular that any changes at least preserve all existing users' rights, including the right to use copyrighted materials under Fair Dealing and the right to make private copies of audio recordings. We further call upon Parliament not to extend the term of copyright; and to recognise the right of citizens to personally control their own communication devices.

Cory Doctorow: The Canadian Petition for User Rights, a statement signed by hundreds of people asking the Canadian government to set out its Internet copyright policies to respect privacy, fair dealing, and due process, was presented to Parliament yesterday. Congrats to Digital-copyright.ca on a job well done.
The second petition is signed by several hundred people, Mr. Speaker, from both Burnaby--New-Westminster and throughout Canada, and focuses on the Copyright act. Petitioners want this house to maintain the balance between the rights of the public and the rights of the creators. They demand that the government not extend the term of copyright, and preserve all existing users' rights to ensure a vibrant public domain. The petitioners also call upon parliament to ensure that users are recognized as interested parties and are meaningfully consulted about any proposed changes to the copyright act.

MP candidates on the "Canadian DMCA"

MP candidates on the "Canadian DMCA" 06/24/2004 09:39 AM
With the Canadian election coming up in four days, Ray called up all the candidates in his riding and asked them what they thought of the Canadian version of the DMCA:
What I believe needs to happen is the creation of a new "industry model", one that understands that all music, programs, books, etc, will be distributed over the internet. What this means is that a huge infrastructure of advertisors, retailers, wholesalers, etc, are going to wither away and have to find new ways of making a living. Instead, modern technology will allow consumers and artists to interact directly. Until industry realizes that this is the new "rules of the game", they will be in the situation of King Canut trying to order the tide to not come in. Part of this realization will be the understanding that consumers simply will not pay the same price for a book, music, etc, that they download and print themselves off the internet that they would have to pay if they went to a physical store and made a purchase. And why should they? They have removed almost all the "middle-men" who previously had to do work to get it into their hands.

iPod Firmware Petition

iPod Firmware Petition 07/22/2004 01:22 PM
With the recent release of the 4G iPods, Apple released an iPod firmware update adding new features/functionality to the iPod. Unfortunately, the new features are only available to 4G ("click wheel") iPods?leaving the not-so-old 3G iPods in the dust. When I first heard about this, my first response was, "Why can?t they just release the same firmware upgrade for both the 3G and 4G models?" I don?t know about models older than 3G, but as far as I know, the new model is exactly the same as the 3G. The firmware could easily work for both. This seems to be a marketing ploy on Apple?s part. Get the people who want these simple new features to buy a whole new iPod. Well, people aren?t buying it. Enter the Apple iPod Firmware Petition, signed by over 3,000 people when this entry was posted, which states the following:
To: Apple Computer We, the owners of previous models of the Apple iPod (1G/2G/3G), believe that we have been snubbed by Apple. With each new generation some or many of the new features added are only software changes, and could be easily added to past iPods with a firmware update. But instead of updating older iPods, Apple has simply ignored older users. We believe that any new improvements that can be added via firmware to the older generation iPods should be instituted Sincerely, The Undersigned
Being a 3G 15GB owner myself, I must agree. How about you?

Level 3 withdraws VOIP petition before

Level 3 withdraws VOIP petition before
FCC
03/22/2005 03:49 PM
Level 3 Communications on Monday withdrew a petition before the U.S. Federal Communications Commission (FCC) that sought to reduce access charges paid to telecommunications carriers when calls originated over VOIP (voice over Internet Protocol) end on the traditional telephone network. Level 3 said in a statement it had withdrawn its request because of a leadership change at the FCC. On March 16, U.S. President George Bush named Commissioner Kevin Martin as FCC chairman, replacing Michael Powell, who left the FCC this month.

The FCC was required to rule on the Level 3 petition by Tuesday if commissioners wanted to deny it. If the FCC failed to act, the Level 3 petition would have been automatically granted. "Given the appointment of new leadership only three business days before the statutory deadline for ruling on the petition, we determined it was inappropriate to ask the agency to resolve this important issue in the timeframe required by law," James Crowe, Level 3's chief executive officer, said in a statement.

Sidekick Synching on T-Mobile Petition 06/10/2004 07:55 AM

Although web petitions are about as effective at charging corporate policy as complaints to customer service agents or extremely huffy forum posts, Levi Wallach is doing what he can to encourage T-Mobile to support synching on the Danger Sidekick -- something promised by the company for years and which is currently being supported by non-U.S. cellular vendor Cable & Wireless. Since all the data that goes to and from the Sidekicks has to go through T-Mobiles servers (instead of just their network), I would guess they would have to upgrade all their internal hardware to support something like this, something perennial tightasses like T-Mobile are loathe to do. But hey, sign Levi's petition and see what they say, if anything.

There are currently 1650 signatories to this petition to Apple to do something about the widespread manufacturing defects with its 15" Rev A Aluminium Powerbooks:
We, the undersigned, demand that Apple Computers immediately acknowledge and address the manufacturing defect on the LCD screens of its Powerbook G4 laptops. The LCD screens of these laptops are susceptible to random “White Spots” appearing on the display. These spots are very distracting and are an obvious manufacturing defect.

Powerbook owners around the world have been complaining of this problem. Evidence of this can be seen on Apple’s own discussion group website located at http://discussions.info.apple.com and on various message board discussion groups on the Internet. Due to the extremely large number of Powerbook owners that have been sending their newly purchased laptops for repair under warranty, it is OBVIOUS that Apple is aware of this defect. However, most customers have been noticing this problem reoccur within hours or days of their Powerbook being repaired under warranty. This is completely unacceptable.

Airbus Withdraws Petition In Microsoft

Airbus Withdraws Petition In Microsoft
EU Case
09/24/2004 04:17 PM
European plane maker, Airbus, has withdrawn its petition in the on going European Union investigation into Microsoft's activities. The withdrawal has been viewed with some suspicion by Microsoft and analysts, as it comes very close to the companies appeal hearing.

Last week, it was made public that Airbus had made a petition to the EU regarding certain points in the ruling that it was concerned about. It expressed concerns that the judgement could restrict its ability to pick suppliers, and might hamper its business. The intervention by the company was seen as a boost to the case for Microsoft, showing the wider implications of a ruling against Microsoft.

Microsoft's chief legal representative in Europe, Horacio Gutierrez, described Airbus' action as ‘unusual’, and strange so close to the companies appeal hearing next week. Trying to put a positive face on the action, he remarked that "these actions may illustrate why other industry leaders have been sympathetic to the merits of our case but reluctant to come forward and explain the negative consequences of the commission's decision".

The case continues; Microsoft's EU appeal begins in a few weeks.
