Senator Tries to Block GMail

Senator Tries to Block GMail 04/23/2004 09:33 AM

Legislator seeks to block Gmail: I don't agree with the senator's logic here. Like I've said before, GMail is essentially a big bribe. In exchange for 1GB of storage, you give up some privacy. So long as people understand that going in, where's the harm? You won't catch me doing it, but other people are willing to live with the creepiness for that much space. I say good for them.

Blasting Gmail as a horrific intrusion into Internet users' privacy, a California state senator has introduced legislation to block Google's free e-mail service.

State Sen. Liz Figueroa, a Democrat from the Bay Area city of Fremont, said Thursday that it should be illegal for a company to scan the text of its customers' e-mail correspondence and display relevant advertising--even if customers explicitly agree to the practice in exchange for a gigabyte of storage.

Okay, I have to admit that I don't really understand the uproar over Google's Gmail offering. The press has had a field day with all the negative attention that Gmail has been getting, and now a California state senator is even drafting legislation to ban Gmail. Why? Because "we think it's an absolute invasion of privacy. It's like having a massive billboard in the middle of your home." Hmm. No, it's not like that at all. It would be like that if a company gave me something of value in exchange for the ability to put a billboard in my house and I agreed to the deal - which seems like a perfectly reasonable transaction between two consenting parties. No one is being forced to use Gmail. If they don't like the fact that Google will put ads in the email client, they're free to not use it. In the meantime, there seem to be plenty of people who want to sign up for the service. Personally, I'll admit that I was invited into the beta and have been messing around with it. I'm pretty concerned about my privacy, but don't see anything wrong with what I've signed up for - and everyone who I've emailed to test the system out has asked me how they can get a Gmail account of their own.

Following up on already announced intentions (and apparently ignoring everyone who explained why this is a terrible, terrible idea), California Senator Liz Figueroa has introduced a bill to ban Gmail saying that - even though Google is upfront about scanning emails to offer contextual advertising and it's a choice of the user - it should be illegal. Her complaint is that Google will use email contents as a "direct marketing opportunity." I hadn't realized that there was anything illegal about direct marketing. If we're going to go after direct marketers there are an awful lot of direct marketing practices that I would target before a perfectly useful, perfectly upfront company's email client.

Anti-Gmail Bill Now Allows Gmail

Anti-Gmail Bill Now Allows Gmail 05/26/2004 01:35 PM
Last month there was a lot of talk about the somewhat clueless move by a California politician to create a law that would ban Google's Gmail offering, despite the fact that it was completely optional to use. It appears that enough people (probably including those at Google itself) sat down with State Senator Liz Figueroa to explain how email works, and have convinced her to tone down the bill so that it now allows Gmail. That's right, the anti-Gmail bill now has loopholes that specifically allow Gmail. In other words, Senator Figueroa seems to have realized just how pointless the bill was in the first place and is trying to save face by adjusting it so that it still seems to have a purpose: banning a bunch of things that no one was doing, like having humans read the content of your emails to put in advertising.
