Last month when everyone was making a big deal over the news that the online game Second Life had decided that players own any intellectual property they create in the game, I said it was a bad idea, since it basically took all of the problems of our intellectual property system and moved them into the virtual world - where it was likely to get more confusing. Over at LawMeme, James Grimmelmann, has been thinking a lot about that very idea and has written an insanely long - but absolutely worth reading - discussion about intellectual property issues as it relates to games. It's impossible to summarize his points, but he explores many of the issues in-depth and appears to have thought about these issues in much more detail than the designers of the various games. What it really seems to come down to is the question of whether or not in-game actions are simply covered by the End User License Agreement (which basically becomes the Constitution for that game) or if real laws in the real world should apply.

Yesterday we wrote about a new conference looking at the issue of how do offline laws apply in online worlds, especially with respect to digital goods within those worlds. Ernest Miller is at the conference and is reporting that Linden Labs, who runs the game Second Life has officially announced that players get the ownership rights to intellectual property created in the game. They've put up a press release with more details. While interesting, I'm not sure this is a good development, since it basically throws the issue out of the online world and into the offline courts. Whereas most games handle such issues internally, Linden Labs is basically punting on the issue to the US court system. I can see the argument for both sides, but I'm not sure what makes the most sense yet. In the same post from Miller, he points out that a representative from There.com says that there have been problems within their world of people wearing "knockoff" clothing. Someone will design a new virtual shirt that looks like a more expensive virtual shirt. Suddenly, all of the problems of our intellectual property system in the offline world will get passed on to the virtual world. Why not use this opportunity to create new and better rules concerning intellectual property online?

Mobile virtual network operators (MVNOs) are nothing new. Virgin, both in the UK and the US, has been quite successful creating their own mobile phone carrier, despite not having a network of their own, but simply handling the branding and management, while leaving all the technology issues to a network operator partner. So far, most MVNOs seem to be targeting the youth market (often with "pre-paid plans"), and considering just how lucrative that market seems these days, it's no surprise that plenty of others want into the market. However, operating the whole MVNO is probably a lot of work, so now we're getting to the point where you have virtual MVNOs (VMVNOs) who will do all the work for a company, and simply slap their brand on the final product. That seems to be what's happening with convenience store 7-Eleven, who has announced plans to sell pre-paid mobile phones and service under the "Speak Out" brand - though, all the work appears to be done by Ztar Mobile. Other retailers are quickly expected to follow. Wal-Mart is at the top of the list, with Costco and Home Depot also apparently considering their own mobile phone offerings. The idea is to target younger users, or those with bad credit histories, who can simply pick up a phone at the store, and use it until their minutes run out, at which point they can top it up again - back at the store, of course.

Another virtual reference failure tonight. Kailee was reading about Neti and Ditto, the cloned monkeys, when she asked if we could find a picture of them. After a couple of fruitless attempts on the web, I again suggested she try my System's virtual reference project since we still had 15 minutes before they "closed" for the night.

So we fired up the URL and after a couple of confusing attempts to connect, we waited for a librarian to "answer" our call. And we waited. And we waited. And we waited. We finally gave up and submitted the question via email, only to be told we'd probably receive an answer in 1-2 business days.

It's extremely frustrating to try to teach Kailee to turn to librarians online for help only to keep running into problems and dead ends when she actually tries to do this. If she didn't have librarian parents, I'll bet she'd be giving up on us now.
