alex writes in with a link to a story about a con man who was arrested for lying to investors about a face recognition system he claimed to be developing to help identify terrorists. Trouble was, he wasn't actually working on any such thing - he was working on scamming investors. The article linked above doesn't give many details, but other articles on the arrest point out that he conned 32 people out of half a million dollars (while another half a million dollars was raised for another fraudulent company the same guy was running under a different name). Once again, it makes you wonder what kind of due diligence these investors do. Apparently, with the face recognition company, investors were told that they had patents pending, that they employed high ranking former Netscape executives, and that they were close to doing an IPO. All of these should have been fairly easy to confirm or disprove.

In a case that could have serious implications for venture capitalists and other investors in companies, the lawsuits that Univers al Studios and EMI filed last year against Napster's investors (including their own rival label Bertelsmann) have been combined into one case that is set to get under way next week. The two labels accuse the investors of being responsible for copyright infringement by keeping Napster in business longer and for inspiring "copycat" sites like Kazaa and Morpheus. Beyond the basic problem that (again) they are blaming the tool and not the actual illegal action, this also opens up a whole can of worms concerning any investment. The investors simply invest in the company, and while they may have some influence over what the company does, to blame them for illegal actions performed by users of a product seems to go well beyond reason. That's like saying we should blame investors in Ford if a Mustang is used to run someone down. It's going beyond blaming a tool that was misused and even beyond blaming the company or its management for creating a tool that could be misused, all the way towards blaming those who kept the company in business with their money. Clearly, without Ford's investors, the company would never be where it is today, and no one would be able to have Mustangs to run over others. Therefore, they must be guilty of manslaughter by association. In fact, why not take it one step further. Perhaps all of Ford's customers should be responsible (even if they only did legitimate actions with their vehicles) because they put money in Ford's bank account letting them stay in business as well. The argument is ridiculous and hopefully the judge will see it the same way.

During a panel presentation on peer-to-peer file sharing at the Educause conference this morning, Graham Spanier , President of The Pennsylvania State University , announced a deal with Napster that will give Penn State students access to music for $.99 per song downloaded. A Penn State press release outlines the way in which the service is expected to work:

• Students living in residence halls at a dozen Penn State campuses will be able to participate initially.
• Unlimited streaming of music files will be available from Napster’s inventory of more than 500,000 songs.
• Tethered downloading is included at no additional charge. This means a student can download and keep the music files on up to three personal computers. These songs can be burned to CDs or transferred to portable devices if purchased for 99 cents each.

Penn State plans to roll out a pilot of the program beginning in January. The deal is being promoted as a way to provide students with the ability to download music legally while addressing issues of bandwidth overload.
