Lenz, a professor at Aoyama
Gakuin University in Japan, has a different perspective on the
INDUCE Act. Of course, there must be something wrong with his
translation, as Dr. Lenz believes the Act is named the "Intentionally
Stopping Advances of the Nation's Economy," or INSANE Act. Anyway, he
is not nearly as opposed to it as many commentators here in the
US:First of all, while it might be true that this
legislation will help to make America a technological backwater, with
iPods and the Internet being illegal under this legislation, depending
on your perspective, that is actually a good thing. It helps Europe
and Japan in the global competition with America to have strange
American laws strangling research and development there, so from an
international point of vie w, I can only say "go
ahead".
Lenz notes that the law could use some
improvements, and if these improvements were made, then, "it might be
better than the Japanese approach of just arresting creators and sort
out later if it was actually illegal what they did."

01/07/2004 06:34 PMA friend of mine once pointed out to me that, on certain CDs that are
quite difficult or expensive to get in the US, if you log in to
Amazon's UK site, you can get them much cheaper. Of course, it looks
like some folks in the UK do the same for getting overseas CDs and
now Amazon is being investigated for breaking copyright law
by shipping overseas CDs to the UK. The complaint here, is that
Amazon is importing cheaper versions of CDs from Asia, undercutting
local prices. While the court may very well rule against them, this
is basic arbitrage that is happening on a global scale thanks to the
easy exchange of both information and product across global borders.
It's going to become increasingly difficult for anyone to try to sell
the same exact product for different prices in different markets - no
matter what the courts decide.

sending
out threatening letters to a movie review site that simply
linked to a site that
used to sell movies that had been
released in Asia, but not in the US. So, now, Wired News is exploring
the tricky legal question of
whether
or not you're allowed to buy foreign DVDs of movies not released in
the US. The conclusion is that you can probably buy a single copy
for personal use. Maybe. You can't, however, sell it anywhere. So,
if you go into a store, and they offer films (or, I imagine, music)
that were released for sale outside of this country, it could be
illegal to buy them. Apparently, despite having this nice global
economy we're all supposed to be a part of, intellectual property law
still means you could be breaking the law if you are buying and
selling products not from this country.

12/03/2003 02:39 PMThe issue of tech companies offshoring programming work is certainly a
contentious one, and Business Week has an article talking about how
one company dealt with the dilemma of saving 50% on salaries (vs. the
standard asking price) by outsourcing to India or, instead,
offering much lower salaries to American workers. The
company found that they were flooded with resumes for the low paying
job - many of which turned out to be high quality programmers. The
company hired four programmers at the lower wages, and used them for
the one project. Two of the programmers were eventually hired on as
full-time employees at regular salaries. Of course, this sort of
thing only works while the job market is weak, but does suggest that
the market is correcting somewhat for boom-time salaries that were out
of proportion with reality. Still, I take issue with the "obvious"
choice, as described in the article, of going with cheaper overseas
workers. I think that the benefits of having local, on-site staff who
you can communicate with directly is quite valuable - often in excess
of the amount of money "saved" in offshore salaries. In this case,
the employer only valued the location at $5,000/year - which is much
less than it's probably worth. The risk in offering salaries that are
so low is that you may get lower quality workers who are much more
likely to jump ship. However, in this case, it's clear that the
employer realized this, and appears to have made his reasons clear to
the employees - and, in fact, adjusted the salaries well upwards for
the employees he wanted to keep. This all brings to mind the whole
concept of "professional internships" that seem to become popular when
the economy is down. People who want to convince a potential employer
of their worth sometimes agree to unpaid (or barely paid)
"internships" to convince the company that they're worth hiring.

12/15/2003 02:27 AMYet another in a long line of "spammer profiles." This one focuses on
two grandparents who spam for a living - but claim that times
are tough for spammers, and they may have to declare bankruptcy. I'm
sure we all pity them and the "free speech rights" go on and on about.
The article does a good job pointing out how spammers are quite
different than direct mail companies - no matter what the spammers
claim. It also points out, however, that spammers are all setting up
shop overseas, where it will be even more difficult to track them down
once the US law legalizing most spam goes into effect. I'm still
wondering why no one is demanding that, if we must pass such a
terrible law, why don't we have some clear review point, six months
from the law going into effect that will show how much more spam is
being received? If it shown (as most of us suspect) that the law does
nothing to stop spam (and may even help increase it), then shouldn't a
Plan B be lined up?
