For those who didn't yet figure it out, even an online "affair" can damage a relationship. That's what a new study says, though, I question the methodology. They study was only conducted with students who may have a fairly different definition of what constitutes a relationship than those out of college and in the working world. Still, as the study shows, even those who don't necessarily think of an online affair as "cheating," most still realize that it would hurt their partner to know about it. It seems pretty obvious that if something you're doing would hurt your partner that it's probably not going to do much good for the relationship.

For quite some time, a bunch of folks have been pointing out that the mobile phone operators are being somewhat idiotic in their belief that they they can be music and media moguls. They got this idea in their head once ringtones started to take off, and rather than thinking they might just be a fad, both the music industry and the mobile operators start drooling over how much money they think they're going to make -- when neither of them seem to actually understand the other's business very much. While the theme of the last few months in the mobile world seemed to be unquestioned acceptance that "content is king" it appears the backlash is starting, as even the folks at Business Week are realizing the mobile operators will never make much money by selling music directly. The article points out what everyone always seems to forget. Even for Apple, the clear leader in selling music online, selli ng music is a loss leader. In other words, the carriers would do better to team up with someone (such as Apple) to handle selling music, and they should just be happy with the increased usage. Of course, instead of that, the operators are complaining that iTune s on phones will take revenue away from them. And, of course, this doesn't even touch on issues like network over-capacity and the fact that people don't want different music services on their phones and on their computers. Between the recording industry and the mobile operators, about the only thing you can bet on is that both industries' short term greed, and total lack of understanding of what users want, is likely to screw up any offerings for quite a few years.

A new study shows that completely unsurprising results that most people don't think the RIAA should be suing people for downloading. While the majority of those over 55 had no problem with the lawsuits, under that age barrier they felt the RIAA was going too far. Of course, the RIAA lawsuits are not about downloading. Every one of the lawsuits so far have been about offering songs (i.e., potentially uploading songs) rather than the actual downloading of songs. Still, it certainly suggests that people are getting fed up with the RIAA's heavy handed tactics.

Can you possibly imagine that people wouldn't like going in to car dealers and buying cars from a profession that seems to be defined by its own sleaze? Indeed, it appears that the less sleaze-inducing internet route for buying cars is picking up steam -- with plenty of car purchases originating online. Also, person-to-person car sales have been increasing as the internet has aided that process, and cut out the need for dealers to broker those types of sales. Meanwhile, fewer people seem to be going to the old newspaper classified section to find out about car deals, as it just doesn't seem efficient any more. The car sellers are looking elsewhere and car buyers prefer going online and avoiding dealers as much as possible as well.

Here's yet another article in a mainstream news source (USA Today) noting that many musicians realize that file sharing has helped them build a fan base who come out to concerts and who feel much more involved with the band. The article includes some quotes from RIAA chief Mitch Bainwol stating the standard line about how the artists can do what they want, but where will that leave the folks at the record labels? Of course, he's basically taking the position that the recording industry is owed their rightful profit, rather than realizing that business models and markets change - and if his constituents can't keep up and come up with new business models, they don't deserve to be in business. The market for horse and buggies dried up when automobiles came about - and no one today would say that we need to artificially prop up the horse and buggy market, like he wants to make sure the recording industry is artificially propped up. If he was really there to help the industry, he'd be telling them that it was time to adjust already and not try to hold back what's inevitable in the industry. Instead, he tries to claim that the record labels are like VCs - a comparison that has been made many times over the years - but which is wrong. At least VCs have (mostly) learned to adjust to market changes over time. The recording industry execs seem to think that markets never change at all.

With all the focus these days on paid search marketing, various luxury brands are now being accused of not understanding the space at all. A study that looked at 23 luxury brands found that searches on those brands often pointed users to sites selling discount products. While some luxury brands have been "concerned" about ownership of their brand name, they've mostly just threatened to sue those using their trademarked names (which, as we've discussed may not make much sense) or have been too afraid of channel conflict to bother with any real online advertising strategy. The report concludes that it's time these luxury brands realize that their affluent customers are online and that it's time to take control of their brand through better search engine marketing... which might just make you wonder if it was sponsored by the search engine marketing folks (or even a search engine itself).

One of the big complaints by victims of identity theft is that the various banks and law enforcement agencies don't really care that much, leaving the individual to have to pick up the pieces themselves. The banks and credit card companies, in particular, have shown a remarkable lack of interest in solving the whole identity fraud issue (though, they'll charge you extra for identity fraud alerts!). However, they're beginning to realize that identity theft is expensive to them too, and claim they're really trying to do something about it this time. Still, things like disposa ble credit card numbers aren't very well promoted, and no one seems to be doing much about reforming how credit agencies work in the first place. Reforming that process would be a huge step in stopping identity theft.

We wrote about the book Innovation and Its Discontents : How Our Broken Patent System is Endangering Innovation and Progress, and What to Do About It earlier this year noting that it sounded quite good, as it not only showed what was wrong, but also suggested a solution. The book still isn't out, but the New York Times has some more information about it, including a discussion on how the patent system got to be so bad, as well as what the book's authors think it will take to change. They say that most companies don't realize how much damage the patent system is doing, and that a very small group of lawyers in the D.C. patent bar have the incentive to keep the patent system screwed up. Thus, the only real change will come when CEOs of companies realize just how the patent system is harming their prospects by turning the whole process into an arms race rather than a system for encouraging innovation. Hopefully, this book will help get the point across.

For years now, a bunch of people have been saying that music is a promotional item, and should be used to sell something else. Each time the topic came up, some recording industry defender would come along and say that was ridiculous, and that if people value music they should pay for it - which was missing the point. It has nothing to do with value, but plenty to do with competitive pressures. It appears that some folks at McDonald's are catching on. They've worked out a deal to give away 1 billion iTunes songs as a promotion. It's certainly not at the level it will eventually get to, but this is actually a step in the right direction. The trick will be when someone realizes that giving away music shouldn't be a 1-time promotion, but a long term deal. Also, it would help if it didn't involve music that was tied down with annoying copy protection. In related news, it looks like more and more people are getting angry about all the different incompatible formats and restrictions on downloadable music. Sooner or later someone is going to realize the full picture: music, by itself, is a promotional item and as such, the more you make it so that customers can do what they want with it - the more they'll want it, and the better a promotional item it will be.

Nielsen/NetRatings is reporting that more and more people are accessing the internet via non-browser applications. 76% of users connect via non-browser applications, with the popular ones being instant messaging and the various media players. I'm not sure why this is a big deal. Lots of people use non-browser applications to reach the internet. This isn't a question of replacing the browser, but other, non-browsing applications using the internet as well, for other, (you guessed it) non-browsing purposes. It really wasn't that long ago that all internet applications were non-browser applications. I'm actually surprised that email applications aren't included at the top of this list. Are that many people really using web-based email applications these days? In the meantime, Jeremy Wagstaff is pointing out that many of these applications are sneakily installed upon startup, so that many users have them connecting to the internet when they don't even know about it, making this study even less meaningful.

It took a relatively small California company called Telestream to bridge the video creation incompatibilities of two PC giants. Apple's Macintosh computers maintain a stronghold in video editing, thanks to their art department-friendliness, a long legacy of use in Avid and competitors' video equipment and Apple's own professional software, Final Cut Pro. While Apple has carved out a video production niche, Microsoft has been trying to control video distribution through its Windows Media Video 9, which is currently popular for Web video, but also has the potential to be used for portable entertainment, DVDs, and even cable-TV distribution. Microsoft recently donated WMV9's codec, called VC-1, to the Society of Motion Picture and Television Engineers (SMPTE), hoping to also make it a TV industry standard.

On Wednesday, the European Court judge overseeing the European Union vs. Microsoft antitrust case did what many observers thought he would not. He denied Microsoft's request that the ordered remedies (including the unbundling of Windows Media Player from Windows) be postponed. Whether or not Microsoft appeals his denial, the Redmond software giant said it will deliver to European OEMs starting in January a Windows-Media-Player-free version of Windows. Microsoft also will publish communications protocols, including some heretofore-unpublished Windows Server ones, as part of the judge's order.

Today at the 2004 International Consumer Electronics Show (CES), Microsoft Corp. announced Windows® Media Connect, technology designed to enable hardware manufacturers to easily develop devices such as Digital Media Receivers (DMRs), which have rich functionality for playing digital media files stored on personal computers over home networks. A broad range of industry leaders have announced their support of this upcoming technology, including leading PC OEMs and consumer electronics device manufacturers including Arcadyan Technology Corp., Creative Labs, Dell Inc., Mediabolic Inc., PRISMIQ Inc., Rockford Corp., Roku, Simple Devices Inc. and Toshiba.
