We've talked in the past about the need to totally rethink spectrum allocation policy at the FCC, or possibly to rethink the FCC itself. So, it's good to see FCC chairman Michael Powell state that "Right now, we're in a terrible position where a company's regulatory treatment is more a matter of from whence they came rather than what they're really doing now." By saying this, he's suggesting he recognizes that squeezing new technologies into old regulations is a recipe for disaster. Unfortunately, his statements before he got to tech policy completely contradict this. He talks about the need to bring indecency laws that now cover broadcast TV to make sure they cover cable TV as well. Leaving aside the question of why an agency whose mission is to focus on spectrum allocation should be involved in any sort of question on indecency, isn't this exactly what he said he didn't want to do with technology policy? He's trying to squeeze new technology (cable TV) into old regulations (indecency regulations for over-the-air broadcast TV).

At last week's Progress & Freedom Foundation Aspen meeting I did a panel with James Taranto, who writes the Wall Street Journal's OpinionJournal.com "Best of the Web" blog. The topic was how political operatives are using the Internet, and how regular folks can do the same in their political activities. As I said in the book, I don't agree with him politically, for the most part, but he does write with real style (and is a thoughtful, nice guy in person). The Sinclair Broadcast Group has joined the broadcasting Hall of Cowardice with its craven decision to prevent its customers from seeing tonight's Nightline broadcast, on which anchor Ted Koppel will read the names and show pictures of the American service men and women killed in the current Iraq War. On Sinclair's home page today is a statement about the company's reason for this move: a claim that the Nightline show is a purely political act. Let's assume for a minute that this is true, and that -- as the statement implies -- the motive is to cast a bad light on the war -- even though Sinclair's statement doesn't begin to make such a case. Does this mean Sinclair will start blacking out the flagrantly pro-administration Fox News programming? You will not be even slightly surprised to know that the various Smiths who run this company are HUGE donors to George W. CHIP GIANT Intel has released some details of its dual core Glenwood and Lakeport chipset to its customers, the original equipment manufacturers (OEM). And it has also projected a series of its own Intel motherboards to support the processors, which are slated to start appearing in the middle of next year. Glenwood chipsts will be available in lead free second layer interconnect SKUs, supporting 1066/800 system buses, and up to 8GB of dual channel DDR2 667/433.

Lakeport will come in two flavours, G and P. The G denotes next generation Intel graphics. The Lakeport P will support 1066/800/533 system buses, dual channel DDR again at 667/533, PCI Express X16 and PCI Express X1, high def audio and will include ICH7. Intel roadmaps show a plethora of own motherboards based on Glenwood, Lakeport P and Lakeport G. It's projecting a total of 12 boards with different feature sets and exotic codenames.

BoingBoing noted yesterday that JibJab, the creators of the hilarious Bush/Kerry/Guthrie parody were facing threat of a copyright lawsuit by the current copyright holders for "This Land is Your Land." Now, the Home Recording Rights Coalition has issued a press release pointing out that when the television news broadcasts promoted the flash animation they were likely "inducing" people to violate copyright, assuming that the animation isn't fair use. Under the INDUCE Act, that could make the broadcasters liable for literally millions of copyright violations. Heh.
